Abstract

An investment facilitation agreement, which is under discussion at the WTO, has a peculiar feature from the perspective of international investment agreement. Multilateral framework of investment rules, which is one of the most difficult issues in the context of global economic policy, is being pursued by developing countries. The prisoner’s dilemma structure of multilateral framework on traditional investment issues such as liberalization and protection is less plausible in the issue of facilitation with its lower expected cost of sovereignty. Developing countries, which are now emerging as providers as well as recipients of foreign direct investment are more likely to reach cooperative outcome of accepting the multilateral agreement that they would not have been able to achieve otherwise. The leading role being played by China is a political economy variable that can affect the processes and the outcomes of the WTO discussion. China has the material capacity to lead investment issues as the world’s second largest source as well as destination of foreign direct investment. However the willingness of other countries to accept China’s leading role is still problematic. While many developing countries seeking economic cooperation with China may support Chinese leadership, China will be constrained by the reluctance of major member countries including the U.S. and India in the WTO’s consensus building process.
