화학물질의 평가 및 등록에 관한 법률(화평법)은 국민건강과 환경보호를 위해 화학물질의 전반적인 관리체계를 구축하고자 도입되었다. 이러한 정책적 목적에서 화평법은 성과를 내고 있으나, 기업의 소재개발과 영업활동을 저해하는 규제로 작용하고 있다. 특히 화평법은 무역제한의 이유로 다른 WTO 회원국으로부터 많은 수의 특정무역현안을 제기받았다. 본 연구는 무역제한효과를 중심으로 화평법이 WTO TBT 협정에 합치하는지를 평가하였다. 이를 위해, 먼저 화평법에 관한 특정무역현안 내용과 우리나라 수입에 대한 영향을 실증분석으로 살펴보았다. 이들 결과에서는 화평법의 실제 무역제한효과를 확인하였다. 그러나 WTO TBT 협정과 결정례에 기초하여 평가할 때, 화평법은 정책적 목적을 달성하는 데 필요하고 덜무역제한적인 대안도 존재하지 않는다. 따라서 본 연구는 화평법이 WTO TBT 협정에 합치한다고 결론을 냈다. 다만 기업비밀보호와 제도의 투명성 재고를 위해 화평법의 적절한 개정과 조치가 필요하다.
Abstract
This paper aims to empirically estimate the effects of K-REACH (Registration, Evaluation, Authorization and Restriction of Chemicals) regulations on Chemical Imports in Korea and analyze its consistency with the WTO TBT Agreement. The empirical results show that K-REACH indeed negatively affects chemical imports of Korea, which is consistent with specific trade concerns from other WTO members. However, based on the TBT Agreement and decisions made by the Dispute Settlement Understanding, we evaluate that K-REACH attributes to achieve its legitimate objective to protect people’s health and environment. Also, there are no alternative less trade-restrictive measures in the view of comprehensive control of chemicals. In this respect, we conclude that K-REACH does not violate the non-discrimination and national treatment principle of the WTO TBT Agreement. However, the Korean government should take additional measures to protect trade secrets and enhance transparency for K-REACH.
