애덤 스미스가 태어난 지 300년이지만 그의 철학은 여전히 유효하다. 그의 인간관, 시장관, 정부관으로부터 사람들이 사회문제를 해결해 나가는 메커니즘을 이해할 수 있다. 규제도 마찬가지이다. 정부가 사회문제 해결을 위해 사용하는 규제는 자주 오작동을 불러일으킨다. 사람들의 유인체계에 부합하지 않는 규제는 문제해결이 아니라 또 다른 혼란과 비효율의 원인이 된다. 한국사회는 규제풍토가 심한 편에 속한다. 국회와 정부의 규제의존 성향, 국민들의 규제선호 성향이 크다. 다른 국가들에 비해 규제정도가 심하고, 반시장정서도 강하다. 애덤 스미스는 공공을 들어 사회문제를 해결하자는 시도를 의심했다. 사실은 몇몇 사람에 특혜를 제공하는 결과를 초래할 가능성이 높기 때문이었다. 반면 자유로운 개인 간의 문제해결이 대부분의 경우 정부개입보다 더 나은 대안이라고 설명했다. 자기 안에 관찰자를 가진 인간은 상호적인 존재이기 때문이다. 애덤 스미스에게 정부는 정의의 덕을 세우고, 치안과 질서를 유지하며, 법집행을 정확히 담당하는 것이 중요했다. 이런 관점에서 보면, 중소기업 고유업종, 대기업 규제, 사회적 기업 같은 한국에만 존재하는 규제는 분명 한국사회 극심한 규제풍토를 보여주는 것이다. 애덤 스미스 300년, 한국사회 규제를 애덤 스미스의 철학에서 조망해 보는 것은 정부역할을 제대로 정립하는데 여전히 중요하다.
Abstract
It’s been 300 years since Adam Smith was born, but his philosophy is still valid. From his view of humanity, the market, and government, we can understand the mechanisms by which people solve social problems. The same goes for regulations. Regulations that governments use to solve social problems often give rise to make malfunction. Regulations that do not comply with people’s incentive system do not solve problems but become a cause of further confusion and inefficiency. Korean society has a highly regulatory climate. The National Assembly and the Government have a strong tendency to rely on regulation, and the public has a strong tendency to prefer regulation. Compared to other countries, regulations are severe and anti-market sentiment is strong in Korea. Adam Smith was suspicious of attempts to solve social problems in the name of the public, because it was highly likely that it would result in giving preferential treatment to some people. On the other hand, he explained that market is in most cases a better alternative to government intervention. This is because humans who have an observer within themselves are mutual beings. For Adam Smith, it was important for the government to establish the virtue of justice, maintain public order and public order, and accurately enforce the law. From this perspective, regulations that exist only in Korea, such as preferential treatments for small and medium-sized businesses, regulations on large corporations, and social enterprises, clearly show the extreme regulatory climate in Korean society. 300 years after Adam Smith born, looking at the regulation of Korean society from Adam Smith’s philosophy is still important in properly establishing the role of government.
