WTO 회색규제의 분쟁해결

초록

본 논문은 지난 20년간 WTO 분쟁해결제도를 통해 제기된 분쟁을 반덤핑, 보조금 및 상계관세, 긴급수입제한 협정 등 회색규제 조항을 중심으로 살펴보았다. 특히 분쟁의 제기, 전개, 성과에 대해 서술적 통계분석을 넘어 계량적 실증분석도 함께 시도하였다. 그 동안 제기된 분쟁 중 절반가량이 관련될 정도로 대립이 첨예한 회색규제는 시간이 가도 꾸준하게 발생되고 있다. 특히, 동아시아 국가들의 분쟁제기가 회색규제에 집중되고 있으며 그 상대는 주로 미국이라는 사실이 통계적으로 유의한 수준에서 확인된다. 또한 회색규제 관련 분쟁은 전체와 비교하여 양자합의에 이르는 정도는 낮지만 대신 패널로 이행되는 비율이 높았다. 그러나 다른 요인의 영향을 함께 고려한 까닭에 통계적 확신을 줄 정도는 아니었다. 반면 회색규제 관련 분쟁은 제소국에 만족한 성과를 주는데 매우 미흡했음을 실증적으로 확인할 수 있다. 이는 결국 UR 당시의 투명성 강화 노력에도 불구하고 회색규제 조치가 보호주의적 수단으로 남용되는 폐해를 막지 못한다는 의미이다. 따라서 DDA 협상재개 등 다자체제를 개선할 기회가 온다면 회색규제 관련 내용을 보다 더 명확히 할 필요가 있다.

Abstract

This paper analyzes disputes through WTO settlement procedures focused mainly on the grey regulation provisions, such as anti-dumping, subsidy and countervailing measures, and safeguard agreements. About the half of all disputes brought to the regime for the last 20 years were involved with the grey regulation provisions and their shares in the overall disputes has gradually increased. East Asian countries have complained especially on the matters and the US seemed to be the main target. While that was a statistically supported fact, there were no significant guarantees that the dispute involved with the grey regulations proceeded to the actual panel activities. However, it could be said that the disputes involved with the grey regulation provisions hardly produced favorable outcomes for the complainants. Findings in this paper showed that, despite the effort to improve transparency of the grey regulation measures, the current provisions failed to prevent the abusive use of the grey regulations as protective measures. With that in mind, efforts should be attempted to clarify the grey regulation measures in the future multilateral trade discussion, likely in the resumption of the DDA round.
