독일 노동조합의 정치참여에 관하여: 정당후원금제도를 중심으로

노동관계의 당사자인 노동조합과 사용자단체는 현대 산업사회의 대표적인 이익단체에 해당한다. 이 연구를 통해서는 노동조합의 정치참여 및 선거참여와 관련하여 비교법적 관점에서 논의를 진행하고자 하였다. 독일의 경우 노동조합과 사용자단체는 사회적 파트너로서 자신들의 이해와 요구를 관철하기 위해 선거에 있어서도 여러 가지 방법으로 참여가 이루어지고 있다. 이 연구에서는 이처럼 독일의 노동조합의 선거참여를 가능하게 하는 기본권적, 노동법적 측면의 법적 근거에 대해 검토하고, 정당에 대한 후원금 지원 현황, 국회의원 배출 현황 등 실질적인 선거참여 상황에 대해서도 검토하였다. 나아가 우리나라의 헌법 및 노동법적 상황, 노동조합의 정치활동 가능성 등과의 비교를 진행하였다. 이를 통해 현실적 측면에서 노동관계 당사자의 선거참여가 한계를 가지는 국내의 법적, 제도적 상황을 명확히 하는 반면, 현대 산업사회에서 노동관계 당사자가 담당해야 할 사회적 기능의 회복을 전제로 우리나라의 선거에 있어서도 노동관계 당사자의 선거참여가 활성화될 수 있는 방안을 제시하고자 하였다.
Abstract
Trade unions and employer organizations, which are parties to labor relations, are representative interest groups in modern industrial society. Through this study, it was intended to proceed with discussions from a comparative law perspective on trade unions' political participation and election participation. In Germany, trade unions and user organizations are participating in elections in various ways to fulfill their understanding and needs as social partners. In this study, the legal basis for basic rights and labor laws that enable German trade unions to participate in elections was reviewed, and the actual participation in elections was also reviewed, such as the status of donation to political parties and so on. Furthermore, comparisons were conducted with the constitution and labor law situation in Korea, and the possibility of political activities of trade unions. Through this, it was intended to clarify the domestic legal and institutional situation in which trade unions' participation in elections is limited in reality, while suggesting a plan to revitalize trade unions' participation in elections in Korea on the premise of restoring social functions.
