Abstract

The grounds for depriving mental Disability of the right to vote are divided into two main categories. First, the deprivation of the right to vote for mental Disability is due to a congenital problem. Second, granting the right to vote to mental Disability jeopardizes fair elections and their votes can be easily manipulated. However, if a problem occurs in the voting process or the voting itself after granting the right to vote to the disabled, the right to vote can be revoked, but preventing them from having the right to vote in advance is a violation of fundamental rights. The grounds for claiming that mental Disability are ‘Inherent problem’ are to look at it from the point of view of ordinary people. From the point of view of the majority of the general electorate, mental Disability are more likely to not understand the nature and importance of voting, and they argue that the participation of the disabled can damage the overall voting results as a result. However, even when depriving voters who are supposed to be incompetent, it has been proven that voters who are presumed to be rational often engage in irrational and undesirable voting behavior in a very serious way in the voting process. Voting is not only about the election of representatives. Voting is at the same time an act of political expression, a means of connecting the electorate and the society, and an essential public consciousness of democracy. Moreover, the problem of the quality of voting results and the fairness of voting are not limited to mental Disability. Hurme & Appelbaum proposed the ‘Competence Assessment Tool for Voting’(CAT-V), which evaluates whether a mental Disability or a ward has the ability to vote. CAT-V measures the level of understanding of the ‘nature of voting’ by voters. In addition, the level of understanding of the electorate about the ‘effect of voting’ is evaluated. Finally, the ‘selection ability’ is evaluated so that the test subject chooses one of the candidates. However, the important thing in the legislation on the provision of electoral qualifications through the verification of voting capacity is not scientific verification, but policy decision-making. In addition, the important reason for excluding voting qualifications based on the results of the evaluation of voting capacity was that the right to vote should not be deprived based solely on a person’s cognitive status. However, since the CAT-V only tests people with cognitive impairment, the voting capacity test is based on their cognitive status. In relation to the exercise of the right to vote by mental Disability, it is worth considering a way to strictly enforce the requirements and procedures for voting aids while having only one voting assistant accompanied by the Public Official Election Act.
