Abstract
The Dispute Settlement Body (DSB) is a quasi-judicial body under the WTO that eliminates the politicization of ordinary issues between nations and seeks objective settlements in accordance with rules agreed upon between nations. is. The DSB has contributed greatly to the “rule of law” in international commerce by incorporating grey area measures not based on WTO agreements and unilateral punitive tariffs by military powers. But the recent DSB doesn't work. Due to dissatisfaction with the trial of the DSB appellate body in the United States, the procedure for selecting members to conduct the review did not proceed, and after December 10, 2019, the minimum number of people required for the trial could not be met. As a result, the members of the Appellate Body were no longer able to handle new cases, and the dispute resolution function was not properly functioning. This is not only because rule-making is not functioning properly, but also because the DSB, the free trade dispute settlement body, cannot play its proper role. It can be evaluated as not fulfilling its role. There are issues with the granting of judicial discretion to the DSB, but according to the delegation model, the DSB's delegation level of judicial discretion is moderate and does not unduly extend the powers of the DSB itself. However, the higher the clarity of the content required by the regulation for judicialization, the greater the delegation index and the discretion of a third party (neutral). Another solution would be to allow DSBs to utilize FTAs when dealing with disputes. If such FTAs can be handled by the DSB, clear regulations will enable the DSB to handle dispute cases and ensure the legitimacy of the DSB's judicial discretion.
