2010년도에는 민사소송에 관한 판결이 다양한 내용으로 대법원은 물론 하급심에서 상당한 양이 선고되었다. 민사실체법과 결합되어 있는 자유심증주의 및 증명책임 등 증거법 분야는 물론 소송비용, 민사집행, 도산, 헌법소원 등 여러 분야에 걸쳐 재미있는 쟁점에 대한 판결도 더러 보여 민사소송법의 일반법적 성격을 보여 주고 있다. 예전에 비해 국제거래, 행정처분이나 특허쟁송 등과 관련한 판결이 별로 보이지 않는 것도 특이하다.
Abstract
The decisions of the Court in civil procedure law during 2010 abound in its’ contents with diversity. They contains complicated civil cases of evidence as principle of free conviction and burden of proof. And they range from the traditional parts of jurisdiction, parties, co-litigation,costs of a lawsuit, oral proceeding, right to elucidation, principle of free conviction, effect of excluding further litigation, rechtsschutz-interesse, evidence, recourse(appeal & re-appeal), retrial, to execution, bankruptcy and constitutional appeal etc. Comparing to recent years precedents of international jurisdiction, administrative measure and patent have reduced this year.
