국제적으로 기후 위기와 지속가능한 소비에 대한 관심이 높아지고 있다. 인류가 기후변화에 직면하여 생산, 소비를 포함한 경제, 환경, 생활 패턴을 근본적으로 변화시켜야 한다는 논의가 활발하게 이루어지고 있다. 이러한 전세계적인 흐름에 맞추어 우리도 지속가능한 소비에 대한 보다 구체적인 논의를 시작하여야 하며, 소비자법이 나아갈 바를 고민하여야 할 시점이다. 이를 위하여 우리에 비해 한발 앞서 관련 정책을 추진하고 있는 EU의 사정을 살펴보는 것은 의미가 있다. 하나의 시장을 표방하는 EU에서는 최근 유럽그린딜을 발표하며 소위 ‘순환경제’를 전면에 내세우고, 이를 실행하기 위한 구체적인 목표를 설정하고 그 실행을 점검⋅보완하며 입법 및 정책적인 노력을 기울이고 있다. 향후 소비자법은 지속가능한 소비라는 가치를 반영하여야 한다. 소비자계약은 점차 계속적 계약의 형태로 이루어지는 비중이 높아질 것이고 서비스 계약도 확대될 것으로 예상된다. 이는 전통적인 계약법뿐 아니라, 물건에 대한 용익권한에 대한 개념에도 변화를 예고하고 있다. 지속가능한 소비 측면에서의 정보 제공과 소비자의 권리로서 수리권도 지속가능한 소비의 전제로서 중요한 기능을 하게 될 것이다. 지속가능한 소비는 거스를 수 없는 방향성을 가지며, 여러 분야와 접점을 가지는 중요한 분야이다. 앞으로 이와 관련하여 소비자사법(私法)상 쟁점뿐만 아니라 다양한 측면에서의 연구와 검토가 이어지기를 기대한다.
Abstract
Interest in the climate crisis and sustainable consumption has been increasing internationally. In the face of climate change, discussions are actively taking place that we should fundamentally change our economic and environmental systems, and lifestyle including production and consumption. In line with this global trend, we should also begin in-depth analysis and discussions on sustainable consumption, and it is time for us to consider where consumer law should go. To this end, it would be meaningful to learn about the situation of the EU, which is promoting related policies one step ahead of us. The EU recently announced the European Green Deal, putting the so-called “circular economy” to the fore, setting specific goals to implement it, and making legislative and policy efforts. Consumer law should reflect the value of sustainable consumption. It is expected that more consumer contracts will be executed in the form of a long-term contract, and service contracts will expand. This predicts a change not only in the traditional contract law, but also in the concept of use rights for goods. In addition, the provision of information for sustainability and a right to repair will play an important role as the premise of sustainable consumption. Transition to sustainable consumption is irresistible and related to multiple legal fields other than consumer law. Various research and review should be followed in the near future.
