계획적 노후화(planned obsolescence)에 대한 EU의 대응과 시사점

초록

지속가능한 생산과 상품의 사용과 관련된 환경 문제가 계획적 노후화 논쟁을 심화시키고 있다. EU에서는 2013년 계획적 노후화에 대한 이정표가 되는 보고서가 나오고 나서, 계획적 노후화는 순환경제에 있어 유럽의 어젠다로 들어가게 된다. EU는 2015년 순환경제 행동계획을 시작으로 2020년에 신순환경제 행동계획을 만들었고, 2050년 탄소중립이라는 목표 아래, 유럽 그린딜, 새로운 소비자 의제와 더불어 친환경적이고 지속가능한 발전을 위해 제도를 정비하고 있다. 유럽 집행위원회는 2022년 3월 30일 불공정상관행지침 및 소비자권리지침을 개정하는 새로운 지침 제안을 발표하였고, 조기 노후화 관행과 관련해서도 소비자 보호를 강화하고자 한다. 불공정상관행지침(UCPD)에서는 중요 정보의 누락은 UCPD 제7조에 위반으로 간주될 수 있다. 특히 블랙리스트라고 불리는 UCPD 부속서 I을 개정하여 모든 상황에서 불공정한 것으로 간주되는 계획적 노후화 유형을 추가하였다. 소비자권리지침(CRD)에서는 내구성에 대한 상업적 보증의 존재에 대한 정보를 소비자에게 제공하도록 함으로써 문제를 해결하고자 한다. 물품매매지침(SGD)은 2년간의 ‘수리받을 권리’를 보장하고 있다. 또한 에코디자인지침과 EU 라벨링 규정은 특정 제품 범주에 대해 계획된 노후화를 방지하기 위한 추가 수단을 제공한다. 2050년 탄소중립이라는 목표는 소비자보호의 영역에서도 지속가능성에 대하여 강조한다. EU에서 수리권에 대한 논의가 본격화된 것은 순환경제로의 전환과 관련되어 있다. 2023년 3월 집행위원회는 수리할 권리와 관련된 새로운 수리권지침을 제안하였다. 순환경제를 앞당기기 위해서는 소비자의 수리권을 보장하는 것이 핵심이라고 할 수 있다. 계획적 노후화에 대한 규제는 많은 이해관계가 걸려 있는 문제이다. 그러나 계획적 노후화에 대한 규제를 생각하기 전에 가장 먼저 고려해야 할 점은 계획적 노후화에 대한 논의를 활성화시켜야 한다는 점이다. 즉 선형경제에서 순환경제로 이행하기 위한 국가적 어젠다의 일부분이 될 수 있는지 판단할 필요가 있다.

Abstract

Environmental issues related to sustainable production and product use are deepening the debate over planned obsolescence. In the EU, after a milestone report on planned obsolescence in 2013, planned obsolescence became EU agenda for the circular economy. EU started the Circular Economy Action Plan in 2015 and 2020 and is organizing the system for sustainable development along with the European Green Deal and New Consumer Agenda under the goal of carbon neutrality in 2050. On March 30, 2022, the EU Commission announced a proposal for new Directive to amend unfair trade practices and consumer rights directives, and seeks to strengthen consumer protection in relation to early obsolescence practices. In the Unfair Commercial Practices Directive (UCPD), omission of material information can be considered a violation of Article 7 of the UCPD. In particular, UCPD Annex I, which is called the blacklist, was amended to add types of planned obsolescence that are considered unfair in all circumstances. The Consumer Rights Directive (CRD) seeks to address the problem by providing consumers with information about the existence of Commercial Guarantees for Durability. The Sale of Goods Directive (SGD) guarantees a two-year ‘right to be repaired’. In addition, Ecodesign Directive and EU labeling Regulations provide additional means to prevent planned obsolescence for specific product categories. The goal of carbon neutrality in 2050 emphasizes sustainability in the area of consumer protection. The full-fledged implementation of the right to repair in the EU is related to the transition to a circular economy. Finally, in March 2023, the Commission proposed a new Right to Repair Directive. Regulating planned obsolescence is a matter of many interests. However, the first thing to consider before regulating planned obsolescence in Korea is that discussions on planned obsolescence should be activated. In other words, it is necessary to determine whether it can be a part of the national agenda for transition from a linear economy to a circular economy.
