Abstract

During the Brexit negotiations, the British government prioritized securing regulatory autonomy over access to the EU market. As a result, the UK secured regulatory autonomy to enact laws different from those of the EU. After Brexit, the British government actively pursued regulatory divergences through the abolition and revision of ‘Retained EU Law (REUL)’. However, due to disappointment with the outcome of Brexit and policy failures, the government changed to the Labor Party, and the UK’s policy also shifted toward minimizing regulatory divergences. However, the EU’s speed of enacting laws in areas such as subsidies, labor and social standards, and the environment and climate has accelerated, leading to passive regulatory divergences between the UK and the EU. Regulatory divergences are likely to further expand in the digital and green transition sectors in the future. On the other hand, the British government is pursuing dynamic regulatory alignment in product environment-related regulations while also focusing on securing new growth engines through regulatory innovation. In conclusion, regulatory divergences are appearing in various forms by sector. Therefore, companies need to adopt different response strategies depending on the regulatory divergences. First, companies should pay close attention to the impact of passive regulatory divergences in the area of level playing field(LPF). Manufacturing companies need to build pan-European integrated supply chains in line with EU product regulations, while new industries such as financial services (fintech) and life sciences need to actively utilize the UK government’s deregulation policies to promote innovation.
