한국의 규제관리제도 및 제도적 적실성

본 연구에서는 한국의 높은 규제관리제도 구비 수준에도 불구하고 낮게 평가되는 운영 수준의배경에 대한 진단을 시도하였다. 규제관리제도를 가치평가제도(valuing), 가치환산제도(pricing), 감축목표설정제도(targeting)로 구분하여 제도적 적실성을 살펴본 결과, 담당 공무원의 전문성 부족과효과적인 집행체계 구축 미흡 등으로 인해 제도 정착에 어려움이 있는 것으로 분석되었다. 보다내실화 있는 가치환산제의 운영과 감축목표설정제의 도입을 위해서는 그 근간이 되는 가치평가제도(규제영향분석)의 내실화가 필요하며, 규제 선진국인 영국과 호주 사례 분석을 통해 규제 담당공무원을 대상으로 하는 전문적인 교육 추진 및 행동통찰력의 활용 등을 통한 규제기관의 문화 변화에대해 제언하였다. 마지막으로 규제 개혁의 효과는 단기적이므로 지속적인 규제 개선 노력뿐 아니라새로이 도입되는 규제관리제도의 효과적인 운영 및 정착을 위해 규제관리체계 역시 지속적으로개혁을 추진할 필요가 있음을 논의하였다.
Abstract
This research aims to examine the underlying causes behind the low-level implementation of the regulatory management systems in Korea despite its well-equipped system. In doing so, the study categorizes the regulatory management systems into valuing, pricing, and targeting systems and assesses the degree of implementation. Based on the adequacy evaluation of each system, the study concludes that the lacking capacity of the regulators and the inefficient regulatory governance prohibit the Korean regulatory management systems from fully achieving its potential. In order for effective implementation of pricing system and introduction of targeting system, the study suggests to strengthen the valuing system by institutionalizing a capacity-building program and promoting proactive behaviors among the regulators as in the cases of the U.K. and Australia. Since the effect of regulatory reform is limited to short-term, it is imperative to proceed not only with persistent efforts with regulatory management systems but also with the innovative regulatory governance structure to efficiently carry out the regulatory reform initiatives in Korea.
