미국의 규제개혁은 비용과 효과를 검토하는 현실적인 문제에서 출발한다. 미국은 오랜 동안비용과 효과에 대한 검토를 통해 규제를 지속적이고도 점진적으로 개선해왔으며, 이는 거의 모든분야의 규제에 대해 예외 없이 적용되고 있다. 이 연구에서는 미국의 규제관리체계를 형성하는이론적 배경으로서 자유주의, 시장, 거래비용, 사회비용과 정부규제의 관계 등에 관해 검토하였고, 그 실천제도로서 효율성을 기준으로 한 신규 규제의 규제품질관리제도와 기존 규제의 성과관리제도들의 특징을 검토하였다. 특히 규제집행의 실효성과 순응성을 높이고 사회비용을 낮추는 데기여하는 규제 투명성 및 개방성 보장 관련 제도들의 검토를 통해 한국 규제관리체계에 주는시사점을 도출하였다.
Abstract
Regulatory reform in the U.S. begins with a practical question of examining the cost and effectiveness. The United States has long and steadily improved regulations through a review of costs and benefits, and it has been applied without exception to regulations in almost every sector. In this study, the author examined the relationship between liberalism, market, transaction cost, total social cost and government regulation as a theoretical background of U.S. regulatory management system. The regulatory quality control system for the newly adopted regulation and the characteristics of the performance management system of the existing regulation review system were examined. In particular, the implications for Korea's regulatory management system were derived through reviewing the regulatory transparency and openness-related-systems that contribute to the effectiveness and compliance of regulatory enforcement and reduce social costs.
