영국의 규제개혁정책에 대한 연구

영국은 규제영향평가제, 규제비용총량제, 기업규제비용 감축목표제 등을 통해 규제개혁을 성공적으로 추진한 국가로 평가받는다. 한국은 영국의 제도를 참고하여 규제비용관리제를 도입한 만큼 영국의 제도를 검토하는 것은 규제개혁정책의 수립에 참고가 될 수 있다. 영국의 기업규제비용 감축목표제는 규제가 기업에 미치는 직접적 영향만 분석하여규제비용의 전가 등 규제완화 효과가 왜곡될 수 있다. 한국의 규제비용관리제는 규제완화가 제3자의 규제비용 부담으로 이어지는 경우, 규제비용의 감축으로 인정하지 않도록개선되어야 한다. 영국은 의원내각제를 채택하여 정부가 폐지를 결정한 규제가 법률개정사항인 경우에도 당정 간 협의를 통해 추진되기 용이하다. 통치구조의 특수성을 고려하지 않고, 규제비용의 감축 실적만으로 규제개혁의 성과를 평가해서는 안되며, 정부가 조속한 규제개혁을 위해 의원입법을 통해 규제영향분석을 회피하는 사례를 예방해야 한다. 1980년대부터 규제개혁을 추진한 영국조차 현행규제의 파악이 미흡하다. 현행규제의 분석이 규제개혁의 기초자료인 만큼 한국은 이를 장기적인 국가과제로 추진해야 한다.
Abstract
The UK has introduced a “Business Impact Target”(BIT) to reduce regulatory costs by £10 billion between 2015 and 2020. The BIT could distort the effects of regulatory reform. Moreover, it is difficult to analyze the cumulative effect of regulations in the BIT. However, there are ways to deal with issues. First, if a policy for reducing regulatory cost on business increases the regulatory burden of others (to a significant degree), the government must incorporate that burden when estimating the cost to businesses. Second, independent departments, like the Regulatory Reform Committee, must conduct assessments of the cumulative effect of regulations. The UK government struggles to understand the existing regulations, while improving quality of regulations. Understanding the effects of existing regulations is critical for regulatory reform. Furthermore, regulators are responsible for knowing how existing regulations affect businesses. Mapping existing regulations presents an opportunity to improve the quality of the regulatory system.
