Abstract
The digital age has changed the traditional paradigm of broadcasting. The development of digital technology, the emergence of an active public, and the dramatic increase in content delivery capacity have shifted the control of broadcasting from broadcasters to the public. These changes provide an opportunity to review and improve the broadcasting entry regulation system. So far, Korea's broadcasting regulatory system has remained largely unchanged since the Integrated Broadcasting Act of 2000. The broadcasting entry regulation and its justification theory, which were designed under the premise of the broadcasting environment in the 2000s, have lost their effectiveness in the digital era. Entry regulations are regulatory measures that require concessions, permissions, registrations, and reports before starting a business or engaging in economic activities. There are typical justifications for each type of entry regulation. In particular, in the case of academic concessions, the number of licenses has been limited due to scarcity, natural monopoly, and significant risks. The entry regulations under the Broadcasting Act and the IPTV Act, which fall under the category of academic concessions, should also be supported by reasons such as scarcity, natural monopoly, and significant risk to justify limiting the number of broadcasting licenses. Broadcasting technologies and methods of delivering broadcast programs have had a significant impact on the system of broadcast entry regulation. The scarcity of broadcasting technologies and methods was assumed in the background of traditional theories, especially the scarcity of spectrum resources, which led to the public interest theory, and the influence theory, which led to the diversity theory. Because it is scarce, it is important from a public interest point of view, that the pervasiveness is large, and the risk becomes significant because the risk is not controlled after the fact. Even when scarcity was overcome to a certain extent, the tradition and logic of entry regulation based on scarcity were maintained, making the number of broadcasting licenses artificially scarce. In the digital age, where scarcity has been overcome, entry regulations should be designed based on the (potential) pervasiveness of broadcasting and proportional to the size of that impact. Except for the scarcity of spectrum allocated for broadcasting, strong entry regulations based on scarcity cannot be justified. Even in scarce situations, the criteria for selecting an operator in a competitive situation and the fairness, objectivity, and transparency of the process should not be confused with the requirements of a general broadcast license. Since the justifications for broadcast entry regulation, such as influence and risk, are 'overlapping' in both consessions and permissions, with only relative differences in degree, it is desirable to reorganize the requirements, examination methods, and procedures of the current Broadcasting Act and IPTV Act into a system consistent with permissions to clearly position the legal nature of broadcasting licenses as permissions. In particular, requirements that allow for discretionary judgment should be minimized. Like a car driver's license, which is issued based on certain competencies, it should be reorganized into minimum human and material requirements to maintain the quality of broadcasting services. It is desirable to minimize the importance of ex ante regulation by reorganizing the requirements of entry regulation around the core values and requirements that broadcasters should have, rather than interpreting and applying requirements that are unpredictable and inaccurate at the ex ante regulation stage and deciding whether to enter or not based on the regulator's perspective and standards. The entry regulation of new media, OTT, should consider that it is losing regulatory equity despite its influence and functions similar to broadcasting, but a cautious approach is needed considering that the way of producing and distributing information based on the Internet, the value of information, the way of selecting and consuming information, and the culture of enjoying it are significantly different from traditional broadcasting, and from an industrial policy perspective, strong regulations such as the Broadcasting Act on a growing industry will cause it to lose its growth momentum.
