Abstract

With a view to preventing Members from abusing sanitary and phytosanitary (SPS) measures as a tool of disguised restrictions on international trade, the World Trade Organization adopted ‘scientific evidence rule’ as a basic principle for justifying SPS measures to protect human, animal or plant's health or life. However, it recognized Member's sovereignty to take SPS measures not based on sufficient scientific evidence, in accordance with relevant provisions of the SPS Agreement where there are threats of serious or irreversible damage. Thus, article 5.7 of the SPS Agreement reflects the precautionary principle by allowing Members to take provisional SPS measures higher than international standard, where relevant scientific evidence is insufficient, but only to the extent that specific conditions are met. In order to perform effectively health policy involving food safety and cope with trade disputes related to food safety, it is very important to maintain harmonious and appropriate balance between human health or life value and free trade value. However, the precautionary principle for human health or life should be actively applied in case of irreconcilable conflict of two values. The exclusion of the application of the precautionary principle may endanger to justify the policies for trade, health and environment which sacrifice human health or life for maximizing free trade benefits. Since science is in essence relative and uncertain, it is necessary to respect minor opinion of scientists, interpret flexibly article 5.7 of the SPS Agreement or reflect the precautionary principle established under international environment law at the SPS Agreement. Proper control on substantive requirements to invoke the precautionary principle is also necessary against the abuse of precautional SPS measures. The precautional SPS measures to be taken where there is much controversy as to scientific evidence of adverse effects on human health or life must be applied only to the extent necessary to protect human, animal or plant life or health, proportional to the seriousness of irreversible damage, non-discriminatory in their application, and reviewed periodically based on available additional information.
