WTO 위생검역협정의 원활한 이행을 위한 위험평가 및 규제채택절차의 해석과 적용

초록

본 연구는 위생검역 분야에서 WTO가 SPS협정을 중심으로 추진하고 있는 자유무역시스템 하에서 우리 나라가 효율적으로 대응하기 위하여 어떠한 정책적 방안을 모색하여야 하는지에 대하여 검토․분석하는 것을 목적으로 한다. 이러한 정책적 방안을 도출하기 위하여 WTO 출범 이후 SPS협정과 관련하여 발생한 5건의 식품안전 관련 분쟁사례를 패널보고서와 항소기구의 판결보고서를 중심으로 검토하였다. 분쟁사례를 검토한 결과, 패널과 항소기구가 WTO/SPS협정의 이행과 관련하여 회원국의 위생검역규제 채택절차의 적용과 이러한 절차가 과학적 원칙에 근거한 것이지를 중요한 판정의 근거로 삼고 있음을 발견하였다. 이와 같은 상황에서, 우리 나라가 WTO의 위생검역에 관한 규범에 적절히 대응하기 위해서는 규제채택절차의 효율적 이행을 위한 단일 질의처의 지정 및 운영이 필요함을 제안하였다. 또한, 위생검역 규제조치 채택에 있어 핵심적 근거로 작용하는 위험평가에 효과적으로 대응하기 위해서는 식품안전과 관련한 시험․분석 결과의 신뢰성 확보 방안이 요구된다는 것을 본 논문의 결론으로 제시하였다.

Abstract

This article aims to explore strategic plans of Korea for the efficient implementation of the WTO/SPS Agreement. For this purpose, dispute cases regarding food safety within the WTO system were reviewed particularly with the reports adopted by the panel and the appellate body. As a result of the analysis of the dispute cases, it was found that the key issue is the adoption procedures of SPS measures by member countries and its application. In addition, risk analysis acts as an important criteria in the ruling of the disputes by the panel and appellate body. Based on this interpretation, suggestions were made to designate and operate a single enquiry point coping appropriately with the adoption procedures of SPS measures on the basis of ‘harmonization' and ‘transparency' required by the WTO, as well as to introduce a system for securing reliability and accuracy of food safety testing and inspection results.
