아동과 청소년의 개념 구분을 통한 사회권 담론과 복지적 개입 고찰 - 아동과 청소년의 권리는 같은가? -

사회권은 국가와 사회의 책임이 뒤따르는 적극적인 권리이며, 특히 생애 발달과정에 중요한 시기인 아동과 청소년에게 매우 중요한 권리이다. 아동과 청소년의 연령 범위가 너무 넓어서 각 연력의 특성에 적합한 사회권을 구현하기 위한 사회적, 정책적 프로그램을 전개하는데 실효성이 떨어질 수밖에 없다. 따라서 본 연구는 아동과 청소년의 연령을 구분하여 그에 따른 사회적 권리를 탐색하고 아동과 청소년의 권리를 보장하고 증진하기 위한 복지적 지원방안을 모색하고자 한다. 연구 결과, 아동과 청소년의 법적 연령과 사회적 인식 및 발달특성을 감안할 때 아동과 청소년을 구분해서 사회권을 논의해야 하며, 이에 따른 복지적 지원방안도 구분하는 것이 바람직함을 확인할 수 있다. 사회권의 관점에서 볼 때, 아동은 사회에서 보호받는 권리를 강화하는 한편, 청소년은 자율적 선택에 따른 책임 있는 권리로 이행하는데 주안점을 두어야 한다. 아동과 청소년의 사회권과 관련한 복지개입인 수당, 교육권, 놀 권리, 환경권 등은 아동에게는 이익의 원칙이, 청소년에게는 자기결정권의 원칙이 더 많이 적용되어야 한다. 본 논문은 아동과 청소년 두 집단의 연령을 구분하여 발달에 따른 적확하고 단계적인 권리를 적용해야 함을 강조한다. 아동과 청소년의 발달단계에 따른 특성에 맞추어 권리의 성격과 유형, 내용을 구체화함으로써 더 실천적이고 실현가능한 권리가 되기 위한 담론을 제기하고자 한다.
Abstract
Social rights are active rights followed by the responsibilities of the state and society, and are very important rights for children and adolescents, especially at an important time in the life development process. The age range of children and adolescents is so wide that it is inevitably ineffective in developing social and policy programs suitable for the characteristics of all the ages. Therefore, this study aims to explore the social rights of children and adolescents and seek welfare support measures to guarantee and promote the rights of children and adolescents. As a result of the study, considering the legal age, social awareness, and developmental characteristics of children and adolescents, it can be confirmed that it is desirable to distinguish between children and adolescents and to distinguish welfare support measures accordingly. From the perspective of social rights, while strengthening children's rights to be protected in society, the focus should be placed on the transition of adolescents to the right to be responsible for their autonomous choices. Welfare intervention allowances, educational rights, play rights, and environmental rights related to children and adolescents' social rights should be more applied to children and to adolescents.
