Abstract

The purpose of this study was to explore, through a comprehensive literature review, the concept, historical development, and policy trajectory of the rights of young children. Specifically, this study analyzed international instruments such as the UN Convention on the Rights of the Child, domestic laws and policy documents related to early childhood, and prior studies addressing the rights of young children. The analysis yielded three key findings. First, the rights of young children constitute a distinct category of rights grounded in their unique developmental characteristics and should be understood as a holistic framework encompassing protection, development, and participation. This emphasizes understanding young children not as passive recipients of rights-based protection but as active right holders, and underscores the importance of recognizing responsibilities alongside their rights. Second, the historical trajectory of children’s rights has evolved from a focus on general children’s rights toward greater recognition of the specific rights of infants and toddlers as a distinct population. In Korea, children’s rights have advanced since the ratification of the UN Convention on the Rights of the Child; however, social recognition and public discourse concerning the rights of young children remain limited, indicating the need for a stronger social foundation and increased public awareness. Third, although institutional efforts to guarantee the rights of young children have continued on the policy front, policies that directly and meaningfully shape young children’s everyday lives remain insufficient, and the substantive realization of these rights is still incomplete. These findings suggest that sustained policy and societal efforts are necessary to ensure that the rights of young children do not remain at the level of formal declarations but are substantively realized across society.
