이탈리아의 협동조합은 1854년부터 시작될 정도로 오랜 역사를 갖고 있다. 제2차 세계대전 종전 이후 1948년 헌법이 제정되면서, 협동조합은 더욱 발전하게 되었다. 이탈리아 「헌법」 제45조는 “공화국은 상호부조의 특성을 갖고 사적투기를 지향하지 않는 협동조합의 사회적 기능을 승인한다. 헌법은 적합한 수단을 통해 협력을 증진하고 보호하며, 적절한 관리를 통해 협동조합의 특성과 목적을 보장한다”고 규정하고 있다. 즉, 협동조합에 대한 근거조항을 두고 있을 뿐만 아니라, 국가가 협동조합을 보호하고 그 사회적 기능을 인정해야 함을 정하고 있다. 그리고 협동조합에 대한 구체적인 규율과 지원제도는 하위법이 담당하고 있다. 협동조합에 대한 일반법적 성격을 갖는 「민법」을 비롯한 각종 협동조합개별법들이 협동조합이 발전할 수 있는 토대를 마련하고 있다. 즉, 이탈리아의 협동조합법은 「헌법」-「민법」-「개별법」의 체계를 갖고 있다. 이탈리아 협동조합법제의 가장 큰 특징은 두 가지를 꼽을 수 있다. 첫째, 협동조합연합회가 이탈리아에서 협동조합이 융성할 수 있던 토대가 되었던 것이다. 59/1992 법률 제11조에 따라 단위 협동조합 수익의 3%를 적립하여 협동조합발전기금으로 사용될 수 있도록 했다. 이는 협동조합연합회가 재정적으로 독립될 수 있는 기초를 제공했다. 둘째, 1991년 사회적 협동조합법의 제정으로 사회적 협동조합이 발전할 수 있도록 법적 근거를 마련했다는 것이다. 사회적 협동조합은 복지수혜대상자의 생활능력을 제고한다는 점에서 새로운 복지모델이 될 수 있다. 이러한 이탈리아 협동조합법제의 특징은 향후 한국의 협동조합법을 개선하는 데 유용한 시사점이 될 것이다.
Abstract
Italian cooperative has a long history starting from year 1854. And the cooperative became more developed when the constitution was established in 1948 since World War II. Article 45 of the constitution enacts that "Republic recognizes the social function of cooperation of a mutually supportive and non-speculative nature. The law promotes and encourages the cooperation through appropriate means. and ensures the characteristics and purposes through appropriate checks." The constitution prescribes that the nation should protect the cooperative and approve to its social functioning along with the articles of evidence. The detailed rules and supportive systems of a cooperative are covered by law. Various specific identification as well as the civil law of which is characterized as a general law of cooperative are preparing a ground for developing the cooperative. So Italian cooperative legislation has a structure of 「Constitution」-「Civil Law」-「Individual Act」The main characteristics of Italian cooperative legislation are two. Firstly the cooperative association formed a basis for the cooperative to be flourish. Each local cooperative saved up 3% of their profits to fund a development of cooperative according to the article 11 of 59/1992 Law. And this formed a foundation of financial independence of cooperative association. Secondly, establishing the law of social cooperative in 1991 formed a legal ground for the social cooperative to develope. The social cooperative can be a new model of an welfare in that it improves independent living ability of welfare receivers. These characteristics of Italian cooperative legislation are very suggestive for Korean cooperative legislation to be further improved.
