정부는 “이상동기범죄”가 사회 문제로 대두될 때 마다 종합대책을 발표하는 등 다양한 노력을 기울이고 있으나, 그 대책이 효율적으로 추진되고 있는지는 의문이며, 선행 연구도 대부분 형사정책이나 정신건강 등 제도개선에 초점을 맞추고 있어 실효성 확보가 어려우므로 보다 효율적인 예방대책을 마련할 필요가 있다. 특히 신림역과 서현역 등 철도시설 등에서 발생한 이상동기범죄는 철도 이용자들에게 공포와 불안감을 높이고 있다. 이에 본 연구는 이상동기범죄에 관한 선행연구 및 문헌을 분석하고, 현행 제도의 문제점을 파악한 후, 관계행정기관을 대상으로 FGI 조사 및 관계자 면접을 통하여 개선방안을 제시하였다. 연구결과, 효율적인 이상동기범죄 예방을 위해서는 공공장소 흉기소지자 단속 강화 및 CCTV 등 범죄예방시설 확충을 우선시하고, 예산과 시간이 많이 소요되는 사법입원제 도입 등은 장기사업으로 추진하며, 이상동기범죄 예방업무를 총괄할 부서를 정립해야 한다. 또한 AI를 활용한 CCTV 등 시스템적 보완과 지자체, 의료기관 등 유관기관 협력체계 및 사회안전망 구축이 필요하다.
Abstract
The government has made various efforts, such as announcing comprehensive measures whenever “Abnormal Motivation Crimes” emerge as a social problem. However, it is questionable whether these measures are being implemented effectively. Most previous research has focused on improving systems such as criminal policy and mental health, making it difficult to ensure effectiveness. Therefore, it is necessary to establish more effective preventive measures. In particular, crimes committed at railway facilities such as Sillim Station and Seohyeon Station are increasing fear and anxiety among railway users. Accordingly, this study analyzed prior research and literature on Abnormal Motivation Crimes, identified problems with the current system, and then proposed improvement measures through FGI surveys and interviews with relevant administrative agencies. The research results show that in order to effectively prevent Abnormal Motivation Crimes, priority should be given to strengthening crackdowns on weapon possession in public places and expanding crime prevention facilities such as CCTV. In addition, long-term projects such as the introduction of a judicial hospitalization system, which requires a lot of budget and time, should be pursued, and a department should be established to oversee the prevention of Abnormal Motivation Crimes. Additionally, it is necessary to supplement the system with AI-based CCTV, establish a cooperative system with related organizations such as local governments and medical institutions, and establish a social safety net.
