Abstract
Recently, the Government of South Korea and the National Assembly have recognized the seriousness of sex offenses and amended related laws to curb of sex offenses. Additionally, electronic monitoring systems, the disclosure system of personal information, and chemical castration have been actively introduced and implemented. Nevertheless, the rates of sex offenses continue to increase annually, and the rate of recidivism has not decreased. This study examined post-conviction sex offender testing(PCSOT), which is widely used in the US and UK for the treatment, management, and control of sex offenders. A number of studies have found PCSOT to be effective not only in reducing recidivism rates, but also in enhancing self-openness and preventing high-risk behaviors. It is also helpful in risk assessment and is an effective way to plan treatment for sex offenders. In Korea, the above technique has been introduced as a pre-trial application for sex offenders who require sexual impulse medical treatment and 1:1 electronic monitoring. However, because of the extremely limited number of the subjects and inefficient operation, it has not worked as effectively as expected. In order to promote the original purpose and more efficient application of PCSOT, details on the qualifications of PCSOT examiners should be stipulated in detail and testing procedures standardized. In addition, the Ministry of Justice should play a leading role as a control tower by improving various laws and regulations related to the efficient operation of PCSOT. In particular, it is necessary to introduce a Containment Model like those widely used abroad and to render the system more appropriate to the domestic circumstances of Korea. Furthermore, it is an essential foundation for the Korean Containment Model to contribute to the protection of the community from sex offenders.
