Abstract
This study aims at exploring potential limitations of applying polygraph examination for post-conviction sex offenders. The use of polygraph for sex offenders has become widely expanded in the field of community corrections as well as law enforcement interrogation sections. Moreover, mandatory polygraph test has been initiated for sex offenders in UK to enhance the important functions of offender supervision in community. However, there are not sufficient cautions against the application and use of polygraph examination toward sex offenders. In this context, the current study focuses on articulating crucial problems of fundamental logic of polygraph test and consideration for utilizing polygraph test. First, due to the fact that Control Questions Test (CQT) has inherent flaws such as non-scientific examination and lack of test validity, it is highly necessary to be cautious to use CQT for convicted sex offenders. Second, the outcome of polygraph for convicted sex offenders is likely to be misguided and biased because the CQT questions in the correctional field are coupled with hypothetical behavior and non-specific event situation. Third, the false negative fallacy of polygraph might result in detrimental outcomes because the sex offenders who were convicted are vulnerable to countermeasures. Therefore, the consequence of using polygraph might be associated with the negative results which include increased level of cognitive distortion, habituation, biased rationalization, and problematic behavior. Further policy implication will be discussed.
