이 논문은 국민권익위원회 경찰옴부즈만의 역할·현황과 문제점 등을 살펴보았다. 이를 바탕으로 경찰옴부즈만제도의 전문성·공정성·중립성 확보를 위한 대안으로 경찰옴부즈만에 대한 신뢰도를 제고하는 개선방안을 제시하였다. 또한 적시성·실효성 확보 방안으로 검찰과 중앙행정심판위원회와의 관계정립을 제시하였다. 마지막으로 실질적인 경찰옴부즈만으로서의 역할을 다 하는 방법의 일환으로 수사옴부즈만 도입을 검토할 것을 제안하였다. 국민권익위원회 경찰옴부즈만이 충분한 법적 근거를 갖고 효율적으로 그 소기의 목적을 달성할 수 있도록 하는 것이 실질적으로 국민의 권익을 보호하는 일일 것이다.
Abstract
This article addresses the legal problems that could happen in case of the intervention of the inquiry team on police investigation of the Anti-Corruption & Civil Rights Commission(ACRC). The Police Ombudsman of the Anti- Corruption & Civil Rights Commission has a sufficient legal basis and efficiently to achieve its desired objective is to protect the rights and interests of the people that actually would be. The analysis on legal basis of the inquiry team on police investigation and comparative approaches with regard to the Ombudsman system help to synthesise the roles of administrative institutions and criminal justice and to develope the improvement plan of the present system of Civil Rights Service. The purpose of Police Ombudsman complaint resolution system and to remedy lies in the rights. Thus, through the means of legally Bay Police Ombudsman for police to deal with people's complaints. The Anti-Corruption & Civil Rights Commission to do so is to protect the rights of the people.
