본 논문은 국제통상 체제의 ‘표준’ 규정의 발전과 제도적 쟁점을 연구하고 디지털통상 제도에 대한 시사점을 논의한다. 표준 규정은 비관세장벽을 다루는 핵심 제도로 운영되고 있으며, 기본적으로 상품무역에 관한 GATT/WTO 무역기술장벽(TBT) 협정을 통해 발전하고 있다. 표준의 준비, 채택, 적용에 관한 모범관행규약의 운용 사례를 분석하면, 표준 정의와 범위가 불명확하고, 민간표준 기관의 이행이 충분하지 않다는 점이 주요 문제점으로 파악된다. 한편, 서비스무역 관련 표준 규정은 서비스무역에 대한 일반 협정(GATS)의 기술표준에 대한 기본 원칙으로 채택되나 활발하게 활용되지 못하고 있고 구체적인 기준 도입이 필요하다. 국제통상 체제의 표준 조항 유형을 종합적으로 고려하면, 표준의 무역 제한 효과를 줄이기 위한 규범과 표준 확산을 통해 무역을 증가시키기 위한 규범, 그리고 투명성 규범으로 구분될 수 있고, 최근 도입된 디지털무역 협정은 표준 개발과 확산을 도모할 목적의 협력 규정을 활발하게 채택한 것으로 분석된다. 표준 개념의 모호성 문제와 협력 규정의 이행 문제가 향후 주요 쟁점 사항으로 제기될 수 있으며, 국제표준 확산을 위한 전략적 노력이 필요하다.
Abstract
This paper explores development and systemic issues of the GATT/WTO rules relating to standards and standard barriers, and discusses their regulatory implications for the provisions concerning standards adopted in major digital trade agreements. The analysis is based on examination of the legal and operational aspects of the Tokyo Round TBT Agreement and the Code of Good Practice annexed to the WTO TBT Agreement, as well as the built-in articles included in the GATS. The GATT/WTO regulatory experience as regards to goods and services standards shows that digital trade negotiations need to further clarify the meanings of major terms like standards and international standards, and seek to strengthen ways for ensuring implementation of the soft-law provisions that support cooperation on standards development and transparency.
