본 논문은 ‘디지털 분야’ 무역기술장벽(TBT) 현안의 최신 동향과 쟁점을 분석하고 디지털 무역 관련 통상제도 개선에 대한 시사점을 분석한 내용이다. WTO TBT 위원회의 특정무역현안(STC) 사례를 활용하여 디지털 분야 TBT 유형과 쟁점을 분석하고 이러한 디지털 이슈와 관련된 WTO 및 FTA TBT 제도, 그리고 최신 디지털통상 규범의 특징과 개선 방향을 연구하였다. 1995-2022년 STC 조치 60건을 분석한 결과, ICT, 통신, 및 사이버보안 관련 기술 장벽 현안이 증가하고 있으며, 특히 사이버보안에 관한 문제가 부상하고 있음을 확인하였다. 또한, 중국 對 미국, EU, 일본 사이의 통상마찰 구도가 심화하는 한편, 복합적인 기술규제 유형과 사안이 늘어나고 있음을 살펴보았다. STC 조치에 나타난 디지털 분야 TBT 쟁점은 투명성 문제가 가장 많았고 국제표준이나 글로벌 관행과 부합하지 않는 조치들이 문제였으며 불필요하게 무역을 제한한다는 주장이 핵심 쟁점이었음을 확인하였다. ICT 분야의 환경 관련 유해 물질 규제, 인증 및 등록제도를 둘러싼 기술 장벽 현안이 대표적인 사례며, 상호인정이나 국제인증서 수용 문제도 빈번히 나타난다. 통신 분야의 무선인터넷 네트워크 표준과 접속을 규제하는 현안, 통신기기의 전자파적합성, 그리고 사이버보안 적합성평가 이슈가 주요 쟁점에 해당한다. 디지털 분야 자유무역을 지속하고 확대하기 위해 비관세장벽에 효과적으로 대응할 수 있는 통상제도가 필요하다. 본 논문은 현존하는 WTO 및 FTA TBT 제도 분석을 바탕으로 규범 개선 및 제도적 절차 보완에 대한 시사점을 제공한다. 더 나아가, 최근 FTA에서 채택되어 발전하고 있는 디지털 분야 TBT 규범과 디지털통상 협정 규범으로서의 TBT 쟁점 관련 조항들을 분석하여 향후 통상제도의 발전 방향을 모색한다. 구체적으로 국제통상 체제의 표준 제도 발전 필요성 그리고 다자적, 사전적 대응인 WTO STC 절차를 적극적으로 활용하는 것은 물론 이와 관련된 국제적 논의에 활발한 참여가 필요하다는 정책적 함의를 도출하며 논문을 마무리한다.
Abstract
This paper examines emerging issues and trends of technical barriers to trade (TBT) within the digital technology sectors and provides insights for improving digital trade-related institutions. Through an analysis of 60 specific trade concerns (STCs) related to ICT, telecommunication, and cybersecurity, the study highlights a significant increase in digital-specific trade concerns, notably becoming more complex, especially in the context of cybersecurity. It also observes that trade conflicts primarily involve China and major counterparts such as the US, EU, and Japan. The study highlights that the majority of trade concerns revolve around two aspects: transparency issues on one hand, and deviations from international standards and global practices on the other. Additionally, it delves into emerging issues, including cybersecurity conformity assessment, international TBT standards usage, growing importance of global practices, and recognition of international certifications. To ensure the continuous growth and promotion of free trade in digital technology sectors, it is essential to establish effective rules and legal frameworks that address emerging issues and new trends of TBT. The paper offers insights into optimizing and enhancing the current WTO and FTA TBT rules as well as TBT provisions stipulated in digital trade agreements. The paper concludes by emphasizing the policy implications of the need for the development of standard in the international trade system and the proactive utilization of the WTO STC procedure, as well as the necessity for active participation in relevant international discussions.
