“기술규정”의 현황과 WTO 법제도에 대한 시사점 연구

초록

기술규정으로 인한 비관세 무역장벽의 문제가 증가하고 있으나 TBT협정이 상대적으로 활용되고 있지 못하는 현상은 TBT협정상 “기술규정”이라는 개념의 모호성과 TBT협정상의 규범이 충분히 구체적이지 못하다는 제도적 문제로 설명할 수 있다. 즉, TBT협정이 다루는 사안은 매우 넓은 적용범위를 갖는 것에 반해, 이를 규율하기 위한 규범이 모호하여 TBT제도가 유용하게 운용되지 못하고 있는 것이다. 본 연구는 다양하고 복잡하게 나타나는 실제 “기술규정” 조치의 사례연구를 통해 TBT협정상 “기술규정” 개념이 갖는 모호성을 분석하였다. 또한 “기술규정”으로 간주되어 분쟁에 제기된 조치들의 유형과 특성을 분석하여 분쟁 대상조치들과 WTO TBT협정의 규범 간의 간극을 확인하고 분쟁해결절차에 대한 시사점을 도출하였다.

Abstract

Despite a constant increase of non-tariff barriers through imposition of technical regulations, TBT Agreement is rarely in use for effective dispute settlement. This research argues that the reasons for such phenomenon can be explained by 1) the ambiguous concept of “technical regulations” under the TBT Agreement and 2) the lack of applicable specificity of the TBT Agreement as an institution. In other words, the ambiguity problem of what the TBT Agreement can regulate is aggravating due to the boundless scope of measures that can be subject to the agreement as technical regulations. This paper analyzed each technical regulation that have been subject to WTO disputes, in order to clarify the ambiguity problem of such concept. Furthermore, this research examined the discrepancy between the scope the concept of technical regulations embraces and the boundary of legal application of TBT rules on technical regulation measures, in order to provide practical implications for dispute settlement.
