Abstract

This study addresses the issue of financial support for the activities of local councilors raised since the implementation of local autonomy under the current Constitution. In 2005, the revision of the Local Autonomy Act provided parliamentary funds to local council members, but various interpretations exist on the nature of this parliamentary fee. Under the current Local Autonomy Act, the parliamentary fees received by local council members are comprised of monthly allowances, parliamentary activity expenses and travel expenses, and there are differences in the legal nature, appropriateness and methods of payment. To this end, first discuss the continuation of payment of expenses to local council members and the process of changing the nature of local council members. In addition, the Local Autonomy Act does not distinguish between allowances received by qualification and expenses paid according to activities. The interpretation criteria for whether they have the nature of the cost or the nature of the remuneration are presented, and the need for criteria for the adequacy of the payment scope and payment methods according to their nature is identified. To this end, the government seeks to improve the system for the cost or remuneration of local council members through comparison with the system for payment of expenses to local council members in Germany and Japan and the system of allowances for lawmakers.
