농촌범죄학적 관점에서의 농촌범죄와 도시범죄의 비교

초록

농촌범죄학은 기존의 사회학 또는 범죄학적 이론 및 연구경향에 대한 반발로 새롭게 범죄학의 연구과제로 등장하기 시작한 페미니즘 및 포스트모더니즘 등과 같이 주류 사회학에서 소외되었던 영역들을 주요 연구대상으로 삼는 비판적 범죄학이라 할 수 있다. 농촌범죄학은 기존의 도시범죄를 설명하는 이론으로 농촌범죄를 설명하는 것은 그 한계가 있다고 주장한다. 또한 최근에는 농촌지역의 구조 및 가정, 사회환경 등의 변화가 농촌범죄의 적극적인 요인으로 작용함으로써 농촌범죄의 발생률도 도시에 비견된다는 연구들도 등장하고 있다. 미국이나 호주, 캐나다, 영국 등에서는 농촌범죄학계를 중심으로 매우 적극적으로 농촌범죄에 관심을 보이고 있고, 연구성과도 꽤 많이 축적되고 있다. 이를 바탕으로 농촌지역의 고령화, 인구공동화, 청소년 구직기회 한계, 교통 및 생활 인프라의 한계성 등을 고려한 범죄예방정책들이 개발되고 있다. 우리나라의 경우 도시범죄에 관하여서는 많은 연구가 축적되어 있지만, 상대적으로 농촌범죄와 관련한 연구는 매우 미미한 실정이다. 이 연구는 첫째, 농촌, 농촌성, 농촌범죄학을 설명함으로써 범죄학의 연구영역을 확장하며, 둘째, 농촌범죄학적 관점에서 농촌범죄와 농촌범죄피해의 특징을 도시와 비교하는 데에 있다. 이러한 연구는 향후 농촌범죄에 대한 후속적인 연구를 이끌어내며, 형사사법당국의 농촌범죄의 예방 및 통제를 위한 정책결정에 기여할 것이다. 이를 위하여 농촌의 개념 및 농촌범죄학의 발달 및 연구명제를 설명하였으며, 농촌범죄의 특징을 밝히고자 대검찰청의 범죄분석통계를 활용하여 2005년부터 2009년 까지 발생한 살인, 강도, 강간, 폭력, 절도범죄를 중심으로 그 실태를 파악하였고, 한국형사정책연구원의 2008년도 자료를 활용하여 농촌과 도시의 범죄피해실태를 분석하였다. 농촌의 살인범죄자 구성비는 다른 대도시인 부산이나 대전, 그리고 특별자치구인 제주, 중소도시인 안동이나 기타도시에 비해서도 결코 낮지 않으며, 평균적으로는 부산지역에 준하는 살인률을 보이고 있다. 강도의 경우에도 대도시 못지않은 발생률을 보이고 있으며, 강간발생률이 가장 높은 지역은 서울이지만, 다음은 농촌지역으로 광역시나 중소도시 이상으로 높았다. 폭력의 경우 서울과 부산 다음으로 많이 발생하는 것으로 나타났으며, 절도의 경우에는 부산과 대전과 같은 광역시나 제주, 안동, 기타도시 보다도 농촌지역의 발생률이 높은 것으로 나타났다. 이와 같이 살인, 강도, 강간, 폭력, 절도 등 5대 범죄의 농촌과 도시의 인구 100,000명당 구성비를 보면, 농촌이 서울을 제외한 여타 도시 보다도 더 그 발생률이 높은 것을 알 수 있다. 이는 기존 범죄학계의 사회적 해체 및 문화적 갈등의 사회 구조적 요인이 범죄를 야기한다는 주장과는 상당한 괴리를 나타내는 것이다. 따라서 사회적 해체현상이나 문화적 동질성을 여전히 간직하는 농촌사회에서의 범죄가 대도시와 유사한 양상을 보이는 이유가 무엇인지를 밝히는 것이 향후 한국 농촌범죄학의 후속적인 과제라는 것을 이 연구는 보여준다.

Abstract

There is little research on rural criminology in korea. This research have two objectives in this study. The primary purpose emphasis about importance of rural crime research through rural Criminology, the second is explaining comparative urban and rural crime in korea. There are some surprising crime cases in korean rural societies. One is animal Cruelty by high school students at Jen. 2011. The students who they are peers fired, kicked, stabbed Neighborhood dogs. The other is murders by elderly fisherman at 2007. The elderly man molested four women victims and killed. Recently rural crime is very serious as urban crime. Besides, the patterns and type of rural crimes are similar to urban crimes. But there is lot of article and text. Especially that situation is more serious in korea than any other advanced country like United States, UK, Australia, and Canada. The rural criminology was began Rural Sociological Society at 1936. But still early 1970, research of rural crime was neglected. At that time, almost sociologists and criminologists have mention to urban crime and social disorganization. It was influence from Chicago sociology school. In 1968, the Omnibus Crime Control And Safe Streets Act was enacted, after the U.S. government supported rural crime studies. Already korea rural is become aging society. Their self defense ability is very weak. Rural people experience special forfeit and theft using their ignorance and weakness. So korean criminologists and government have to mention about rural crime. This research compared murder, robbery, rape, and violent crime, theft of rural society with capital, largest city, middle city and small city, rural from 2005 to 2009. This research found for murder, there is 0.4 murder in capital, 0.2 murder in largest city and 0.2 murder in rural per one hundred thousand. The others are also similar to murder. This results appear to need about preventive policy of rural crime and break the illusion as rural society life is safe than urban. Also the spatial milieu, economic and social condition of youth in rural are far from complete. They are likely to be deviant youth. On several studies suggests that social bonding, peers attachment in rural youth are more strong than city. That are bringing maybe negative consequences as peer delinquency.
