Abstract

Administrative legislation refers to norms established by administrative agencies in the form of orders or rules under the delegation of statutory law. These norms can affect the rights and obligations of citizens. However, under the current Constitution of South Korea, judicial review of such orders and rules is permitted only when they are deemed to be a prerequisite for adjudication in a specific case. This restriction confines judicial norm control to the resolution of concrete disputes. Norm control is a system that reviews whether lower-level norms violate higher laws. It is generally categorized into concrete norm control and abstract norm control, and further classified into principal (direct) control and ancillary (indirect) control depending on the effect of the review result. South Korea’s current system primarily focuses on concrete and ancillary control. However, considering the extensive influence of administrative legislation, this approach is insufficient for effective oversight. Article 107(2) of the Constitution provides that the Supreme Court may conduct final reviews of the constitutionality or legality of orders and rules only when such a review is a prerequisite to a trial. This effectively excludes abstract and principal norm control. Court precedents also follow this interpretation, recognizing the invalidity of administrative legislation only within the scope of specific cases, and denying any broader legal effect. While the Supreme Court may state in the reasoning of its decisions that a certain order or rule is invalid, this is not reflected in the operative part of the judgment, thus limiting its legal effect. There are two potential solutions to overcome these limitations. First, the Administrative Litigation Act could be amended to introduce a norm repeal litigation system, allowing courts to directly determine the unconstitutionality or illegality of administrative legislation and explicitly invalidate it. Second, the constitutional requirement of “prerequisite to adjudication” could be abolished through constitutional amendment. This would enable courts to independently review the validity of administrative legislation and issue decisions with general legal effect. Although administrative legislation is based on statutory delegation, it often involves discretionary judgments by administrative bodies and exerts wide-ranging influence. If courts are unable to effectively exercise norm control over such legislation, it becomes impossible to prevent violations of citizens’ fundamental rights in advance. Therefore, while acknowledging the constraints of the current constitutional and legal framework, it is necessary to pursue legal reforms and a progressive reinterpretation of the Constitution to ensure substantive norm control.
