해상보험계약상 선박충돌로 인한 선체잔존물의 소유권에 관한 연구

본 연구에서는 해상보험계약상 선박충돌로 인해 추정전손이 발생하여 피보험자와 선체보험자 간에 전손잔존물의 소유권에 대해 쟁점이 된 WD Fairway호 사건을 중심으로 분석한다. 이 사건에서 보험자는 선체의 소유권 취득을 선택하였다. 이 선택의 통지에 대해 피보험자는 모든 보험자가 선택하지 않는 한 소유권 취득은 무효라고 주장하고 2009년 1월에 자사 그룹인 나이지리아법인에게 1,000 유로를 지급하고 본선을 매각하였다. 그 후에 피보험자는 제3의 중립의 감정인에 의한 평가감정액을 보험자에게 지급할 것을 제안하였다. 그런데 보험자가 이것을 거부하여 영국에서 소를 제기하게 되어 전손금 지급 후의 선체에 관한 권리의 취급이 논쟁되었다.
Abstract
The purpose of this study aims to analyse the issue of property rights of residuals the between insured and insurers for the constructive total loss caused by ship’s collision under marine insurance contracts with the WD Fairway case. In this case, insurers chose the acquirement of property rights of hulls. As long as all insurers in related to this case do not choose for the notice of this choice, insured asserts as avoidable for the acquirement of property rights, and he sold the ship at 1,000 ECU to Nigerian Company, dated January 2009. Insured suggested insurers to pay valued assessments according to the third neutral surveyor. But insurers refused to pay the valued assessments, insured took an action against insurers in English Court.
