Abstract

In 1972, The General Conference of the UNESCO, at its 17th session, adopted the Convention concerning the Protection of the World Cultural and Natural Heritage(World Heritage Convention) as the cultural heritage and the natural heritage had been threatened with destruction. It declares that world heritage need to be considered as heritage of mankind as a whole and it is incumbent on the international community as a whole to participate in the protection of heritage. At the same time, it means the world heritage protection system has been established with legal binding force. The purpose of the Cultural Heritage Protection Act is to promote the cultural edification of Korean nationals and to contribute to the development of human culture by transferring national culture and enabling it to be utilized through the preservation of cultural heritage. This Act also declares that cultural heritage is heritage of mankind as a whole, and it provides the subject and the process of the registration of world heritage, measures for the protection of a world heritage to the level equivalent to the State-designated cultural heritage, and the monitoring system for regular investigations. However, current Cultural Heritage Protection Act is not enough to protect world heritage effectively. So, this study suggests several reform measures as following; At first, as the legislative structure, this suggests to create a chapter, entitled Registration and Protection of World Heritage, in cultural heritage protection act to manage world heritage unitarily and to complement the regulations of convention and Operational Guidelines. Secondly, as the preservation and monitoring structure of world heritage, this suggests to create the legal ground on establishment of the preservation plan for world heritage, and to complement the regulations of the integration of world heritage preservation and planning systems, establishment and maintenance of Buffer Zone, guest management through capacity assessment, cooperation with related agencies and citizen participation, sustainable utilization of world heritage and financial stability, routine and special management and monitoring system, etc.
