「세계유산법」 도입에 따른 한국 지역사회의 세계유산 거버넌스 참여에 대한 분석

초록

1972년 채택된 「세계문화 및 자연유산 보호에 관한 협약」(이하 ‘세계유산협약’)은그 다섯 번째 전략목표로 지역사회를 채택하며(2007년), 지역주민의 참여가 세계유산의보존관리에 필수적 요소임을 확인한 바 있다. 아울러 협약의 「운영지침」의 지속적인개정을 통해 지역 공동체와 유산의 연결고리를 더욱 강화시키고자 하였다. 한국은 1988 년 「세계유산협약」에 가입한 이래 오랫동안 문화재보호법을 통해 협약을 이행해오다최근 「세계유산의 보존⋅관리 및 활용에 관한 특별법」(이하 ‘세계유산법’)을 제정하고세계유산과 관련된 주요 결정과 추진 과정에 지역주민의 참여를 증진시키기 위한 법적기반 확대를 시도하였다. 이러한 맥락에서 동 연구는 한국의 세계유산 보존, 관리, 활용 등과 관련된 거버넌스에 지역주민의 참여가 얼마나 법제도적으로 보장되어 있는지를 검토하고, 실제 세계유산이 위치한 지방자치단체의 현황을 분석하였다. 또한 실제로 경주, 공주, 부여 등 대표적 세계유산도시의 관련 사업의 결정과 추진 과정에 지역주민들이 얼마나 참여하고있는지를 살펴보았다. 「세계유산법」은 「세계유산협약」에서 강조하고 있는 지역사회의 참여를 전반적으로잘 반영하고 있으나, 좀 더 적극적인 주민 의견 수렴과 그 참여 보장에 대해서는 개선의여지가 있으며, 세계유산도시의 관련 조례 역시 향후 적절히 수정되어야 할 필요가있다. 또한 유산 현장에서의 세계유산 거버넌스에 대한 지역사회의 참여는 다양한 방식을 통해 점차 증진되고 있으나, 주민을 대상으로 한 지자체의 더 많은 사업 홍보와교육을 통해 그들의 자발적 참여가 지속가능하도록 독려해야 할 것이다. 그 가운데지자체와 주민 간 대화를 촉진하는 전문가의 중간자적 역할 또한 확인되었다. 이러한방안들은 향후 지역사회의 더욱 활발한 세계유산 거버넌스 참여 보장을 위한 「세계유산법」과 관련 지자체의 법제도적 보완과 함께, 세계유산 사업 추진 과정에도 구체적시사점이 될 수 있다.

Abstract

The Convention Concerning the Protection of the World Cultural and Natural Heritage, adopted in 1972 (hereinafter, ‘World Heritage Convention’ or ‘Convention’), emphasized the participation of local communities in its implementation, and this has been continuously reaffirmed through the fifth ‘C’ (i.e., Communities) of its Strategic Objectives adopted in 2007 as well as in the recent revisions of the Operational Guidelines. The Republic of Korea has implemented the Convention, since its ratification in 1988, through the Cultural Heritage Protection Act, and recently adopted, in 2020, the Special Act on Preservation, Management and Use of World Heritage (hereinafter, ‘World Heritage Act’) for improved stewardship of World Heritage Sites in Korea and further involvement of local community in the various issues related to World Heritage. In this context, the present research analyzed the participation of local communities in governance on the protection, management and promotion of World Heritage Sites in the relevant legal and policy texts of the Republic of Korea. It also aimed to have a close look at the current situation of the World Heritage Cities concerning the involvement of the local residents through the cases of three World Heritage Cities in Korea, namely Gyeongju City, Gongju City, and Buyeo County. Overall, the provisions of World Heritage Act well reflect the importance of community involvement that has been stressed in the Convention, but there exist a necessity for further development concerning more active accommodation of local residents’ ideas and guarantee of their participation. Relevant ordinances of World Heritage Cities need to be revised accordingly as well. In practice, it is recognized that local communities’ participation in governance of World Heritage has been enhanced through various methods, but local government’s more active promotion and education on the policies and activities of World Heritage seems necessary to encourage local residents’ continuous voluntary participation in governance for World Heritage. Moreover, the research identified a possible role for experts in facilitating communication between local governments and residents, which possibility will be explored further. These can be the ways in which the new World Heritage Act and relevant legal and policy measures of World Heritage Cities can be improved for further involvement of local communities in governance for World Heritage, and good references in the course of the implementation of projects for World Heritage management and promotion.
