이 논문은 송덕수 교수님께서 1985년에 발표하셨던 논문 “이행불능에 있어서 이른바 대상청구권 –독일민법과의 비교ㆍ검토-”에 대한 의미를 분석하는 Review논문이다. 본고에서는 대상논문의 주요내용과 특별한 내용(II), 논문의 주제에 관한 당시의 국내 학설ㆍ판례의 모습(III), 발표 당시 및 현재에 있어서 대상논문의 의미(IV), 향후의 연구방향 및 내용(V)에 대하여 분석하였다. 국내에서 발표된 대상청구권에 관한 논문들은 독일민법 규정이나 문헌들을 검토하고 우리의 경우에도 독일민법과 마찬가지로 해석할 수 있다는 내용이 주를 이룬다. 독일민법전에는 민법제정 당시부터 현재에 이르기까지 대상청구권에 관한 명문규정을 두고 있기 때문에 독일학자들은 이 청구권의 기초가 되는 규정을 중심으로 논의를 전개한다. 그런데 우리의 경우에는 대상청구권에 관한 근거규정이 없는 상태에서 연구를 진행하기 때문에 대상청구권 제도의 인정필요성에서부터 논의를 시작해야 하는바, 이 제도의 근원(Quelle)을 살피는 종적인 연구가 선행되어야 한다. 그 밖에 문헌 및 판례에서 대상청구권을 인정하는 것에서 나아가 민법전에 대상청구권에 관한 규정을 신설하는 경우를 상정한다면, 이 채권적 권리와 다른 민법상 권리들과의 관계에 대한 횡적인 연구도 이루어져야 한다.
Abstract
This article analyzes the meaning of Prof. Tuck Soo Song’s article “Claim for the Substitute in the Case of Impossibility of Performance –Comparison and Review with the German Civil Law-” published in 1985. In this article, the authors analyze the main and special contents of the article at issue(II), the state of the theories and precedents in Korea at the time of publication of the article at issue(III), the significance of the article at issue at the time of publication as well as the present day(IV) and suggest directions for future research(V). Articles on the claim for the substitute published in Korea are mainly based on reviewing of the german civil law regulations and/or literature and interpret our cases based on such as well. Because the German Civil Code(BGB) has explicit provisions on the claim for the substitute since its enactment, german scholars often begin their discussion from such foundation. On the other hand, because there is no such explicit provision in Korea, the research in Korea must begin with the necessity of acknowledging the claim for the substitute system. As a result, a longitudinal study to examine the source of this system should precede. In addition, if assuming that the provisions on the claim for the substitute are to be added to the Korean Civil Code, cross-sectional research should also be conducted with other rights under the Korean Civil Law.
