Abstract
As science and technology advance, we can easily meet smart products in our daily lives. They come in a wide variety, from smart phones, smart refrigerators, to e-book readers. In this study, we examined the issue of providing updates for e-book readers to function, focusing on the provisions of the EU Sales of Goods Directive. E-book readers are subject to the Sales of Goods Directive because they are products that can use digital content or digital services that are included in or interconnected with the Goods. Sellers are required to provide updates for their goods, and the rules for update obligation are innovative regulations that can enhance protection of users’ rights. Any updates required to maintain the performance or operation of the product in accordance with the regulations must be provided by the seller. The period of provision must be guaranteed for at least two years. Sellers must inform consumers about updates in an appropriate manner when updates are available, and must also inform consumers of any disadvantages they may incur if update installation fails. According to regulations, it is not the consumer's responsibility to update the e-book readers, but if updates are not installed, the user may suffer certain disadvantages. Looking at the provisions of the EU’s Sales of Goods Directive, there is a problem that needs to be solved in providing updates. The problem of determining a reasonable period of time for which updates can be expected in a contract where goods with digital elements are supplied in a single act. This may result in additional burdens for sellers due to the obligation to update goods, and also creates legal uncertainty regarding the period.
