(Proceedings of the Royal Society of Medicine)≫ ‘의학사(The History of Medicine)’ 부문에 게재되어 영국 의학계의 인정을 받았으며, 유럽에서 중국 법의학 문화를 접하는 주요 참고 문헌으로 활용되었다.
Abstract
This study examines the transmission of Chinese forensic medicine to the West through Herbert Allen Giles’s (1845–1935) English translation of ≪洗冤集錄(Xi Yuan Ji Lu)≫. Giles, active from the late nineteenth to the early twentieth century, played a crucial role in introducing Chinese law, religion, literature, and customs to Western audiences through extensive translation and commentary. Among his works, the translation of ≪Xi Yuan Ji Lu≫ is regarded as the first relatively complete English rendition of the text. Published in 1924 in the Proceedings of the Royal Society of Medicine, under the section “The History of Medicine,” it was recognized by the British medical community and served as a major reference for European readers encountering Chinese forensic culture. This paper first investigates Giles’s motivations for translation and, based on this, analyzes the transformations observed in his translation namely, changes in narrative structure, reinterpretation of institutional terminology, reorganization of medical knowledge, and selective adaptation of content. Giles reconstructed the complex structure of the original text into a step by step and logically ordered form familiar to Western readers, thereby enhancing readability and accessibility. Furthermore, within the Western epistemological framework, he redefined administrative and medical terms to eliminate exotic and mystical elements, presenting Chinese forensic knowledge as a more scientific and rational system. At the same time, under the moral and religious constraints of his era, he adopted a cautious editorial approach, selectively modifying or omitting certain parts of the text. While Giles’s translation significantly improved Western readers’ comprehension and engagement, it also diluted the indigenous characteristics of Chinese forensic medicine and weakened its institutional and administrative context. Nevertheless, Giles’s rendition of ≪Xi Yuan Ji Lu≫ stands as a representative example of cultural translation at the intersection of Eastern and Western civilizations in the nineteenth century.
