19대 국회의원선거에서 재외국민에게도 선거권이 허용되어 재외선거가 실시되었다. 그러나 저조한 투표참여율로 인해 재외선거의 실효성이 의문시되고 있다. 재외선거의 참여율을 높일 수 있는 방안을 제도적으로 적극 검토해야 한다. 개정 공선법은 대통령선거와 임기만료에 따른 비례대표국회의원선거에만 재외선거인의 선거권을 부여하고 있고 지역구국회의원선거에는 선거권을 부여하지 않고 있다. 이러한 법규정은 보통선거원칙과 평등선거원칙에 위반되게 된다. 현행 재외선거인 등록신청의 경우와 같이 공관에 직접 방문하여 등록신청하는 방법으로는 투표율을 높이기 어렵기 때문에 다양한 방법이 강구되어야 한다. 이에 ‘준영구명부제’를 도입할 필요성이 있다. 또한 투표방법의 다양화가 법제도적으로 보장되어야 재외선거의 투표율이 높아질 수 있다. 재외선거에 있어서 투표소에서의 투표의 현실적인 어려움과 선거권의 용이한 행사를 위해 우편투표나 인터넷투표를 적극적으로 도입해야 한다.
Abstract
The revised Election Law including the system of overseas Koreans voting right was enacted. But there are some problems to protect all overseas citizens' suffrage. First of all, a time limit to the application for an election is too short to register overseas citizen lists. Secondly, a time limit to the voting period is also too short to vote because, some countries is so large that citizens lived there cannot reach polling stations easily. Futhermore, the majority of overseas Koreans will have to travel several hours and some will have to cross borders two times to register and cast a ballot. And among 175 countries with a Korean population, the Ministry of Foreign Affairs recognizes only 160 government buildings as polling stations. So the voting method is diversified such as postal voting, internet voting. Finally, election campaigning by organizations affiliated with political groups or whose name indicates a certain candidate or political party is against the law, but it will be very difficult to monitor or punish them. For such reasons, the system of overseas Koreans voting right is more specifically considered to protect abroad citizens's suffrage in practice.
