젠더기반폭력으로서 친밀 관계 폭력의 개념에 대한 고찰과 향후 과제

초록

본 연구는 친밀 관계 폭력의 근절과 실효성 있는 대응 방안 마련을 위해서는 젠더 및 젠더기반폭력 개념과 현대사회의 친밀성의 변화에 관한 실질적인 이해가 필요하다는 문제의식을 바탕으로, 관계적 친밀성에 기반한 젠더기반폭력의 유형과 개념을 검토하고 분석하여 친밀성의 변화에 따른 젠더폭력 대응의 방향과 향후 과제를 모색하기 위한 목적에서 수행되었다. 이를 위해 여성에 대한 폭력(VAW), 젠더기반폭력(GBV), 젠더에 기반한 여성폭력(GBVAW), 가정폭력(DV), 친밀한 파트너 폭력(IPV), 교제 및 관계폭력(DRV) 등 완전히 동일한 의미를 갖지는 않지만 상호 교차하면서 중첩되는 의미를 갖는 용어들의 개념과 정의를 검토하고, 각각의 용어가 함의하는 정치적이고 전략적인 의미를 이해하기 위해서는 사회질서에 내재된 개념이자 범주로써 젠더에 대한 이해가 반드시 선행되어야 함을 주장하였다. 또한 혼인 및 혈연 관계를 넘어서는 친밀한 파트너십 형성이 증가하고 있는 현실과 보편적 권리로서 누구나 가족을 구성할 수 있는 권리를 바탕으로, 기존의 전통적 방식과 다른 양상으로 나타나는 친밀성에 근거한 젠더기반 폭력의 사각지대를 발굴하여 대응해야 할 필요성에 대해 제시하였다. 무엇보다 이러한 논의의 궁극적인 목적이 지금까지 사회의 젠더질서와 규범 속에 숨겨져 왔던 다양한 피해자들의 경험을 드러내기 위함이며, 이를 위해서는 피해자들의 경험을 최대한 포괄하여 피해지원의 사각지대 없이 모든 이들의 안전과 일상의 삶을 보장하기 위한 방법이 지속적으로 모색되어야 함을 주장하였다.

Abstract

This study aims to examine the types and concepts of gender-based violence based on relational intimacy in order to address the directions of gender-based violence responses and the future tasks. To achieve this goal, this study reviewed and analyzed the concepts and definitions of violence against women (VAW), gender-based violence (GBV), gender-based violence against women (GBVAW), domestic violence (DV), intimate partner violence (IPV), dating and relationship violence (DRV), which, although not fully synonymous, intersect and overlap in meaning. It was argued that it is essential to understand gender as an inherent concept and category within social order and structure for comprehending the political and strategic meanings and implications of each term. In addition, it was emphasized the necessity of addressing the blind spots of gender-based violence hidden in changing norms and practices of intimacy, which is beyond traditional marital and kinship relationships, by highlighting the growing formation and practices of various intimate relationships in the contemporary society and the right to establish a family as a universal right. Above all, it was argued that the ultimate goal of these discussions is to shed light on the diverse experiences of victims/survivors of gender-based violence, concealed by societal gender order and norms. Furthermore, it was suggested that continuous efforts should be made to ensure the safety and well-being of all victims by collecting information about their experiences of violence.
