간접민주주의의 의사결정방식인 다수결 원칙이 중심과 주변으로 양분된 가치다원주의 현실을 평화로운 공존으로 전환시키기 보다는 가치다원주의 현실이보여주는 중심(다수)과 주변(소수)이라는 위계적 관계를 재생산하는 제도적 장치로 기능한다는 점에서, 필자는 간접민주주의 하에서 문화적 소수자의 권리확보를 위한 두 가지의 대안적 방식을 제시한다. 이 두 가지의 대안적 방식은공히 간접민주주의의 의사결정방식인 다수결 원칙에 대한 보완책으로서의 의미를 지닌다. 이 두 가지의 대안적 방식은 통약가능성에 기초한 공화주의적 접근과 통약불가능성에 기초한 자유주의적 접근으로 대별된다. 전자는 통약가능성에 기초하여 공적 영역(public realm)을 통한 문화적 소수자의 권리 확보 방식이다. 공화주의는 공적 영역을 통해서 정의(justice)의 문제를사회적 연대에 기초해서 다룬다. 이것은 문화적 소수자 권리보장을 위한 정치적접근이라 할 수 있다. 후자는 통약불가능성에 기초하여 문화적 소수자의 지위의평등을 전제로 한 동등한 참여를 지속적이고 안정적으로 보장하는 위헌법률심사제도이다. 위헌법률심사제도는 문화적 차원에서 보여주는 중심과 주변이라는 위계적관계를 해체시켜 상호작용의 공정한 조건에 대해서 동의하는 모든 시민들에게 인정요구를 도덕적 차원에서 정당화하는 제도적 장치이다. 이것은 문화적 소수자 권리보장을 위한 사법적 접근이라 할 수 있다.
Abstract
The principle of majority rule, which is the decision-making method of representative democracy, tends to function as an institutional mechanism that reproduces the hierarchical relationship between the center (majority) and the periphery (minority) reflected in the reality of value-pluralism, rather than transforming that reality into peaceful coexistence. In this context, the author proposes two alternative approaches to secure the rights of cultural minorities under representative democracy. Both approaches serve as complementary measures to the principle of majority rule in democratic decision-making. These two alternatives can be broadly categorized into a republican approach based on commensurability and a liberal approach based on incommensurability. The former, grounded in commensurability, seeks to secure the rights of cultural minorities through the public realm. Republicanism addresses the issue of justice on the basis of social solidarity through public engagement; thus, it represents a political approach to the protection of cultural minority rights. The latter, grounded in incommensurability, is the constitutional review of statutes, which presupposes equality in the status of cultural minorities and guarantees their equal participation in a continuous and stable manner. Constitutional review functions as an institutional mechanism that dismantles the hierarchical relationship between center and periphery at the cultural level, thereby morally justifying the claims for recognition made by all citizens who agree on fair conditions of interaction. This represents a judicial approach to the protection of cultural minority rights.
