Abstract

While GenAI could foster an ecosystem of democratic creation and innovation, professional writers and other artists fear being replaced by GenAI, citing anxiety about job loss. In reality, there are an increasing number of lawsuits between copyright owners and GenAI developers all over the world including Korea. Major broadcasting companies like SBS, KBS, and MBC filed a lawsuit against Naver, claiming that its unauthorized use media data constitutes copyright infringement and unfair competition in Korea. The core of the lawsuits filed by copyright owners is whether GenAI's use of copyright works during its learning and output stages constitutes copyright infringement or fair use. In light of domestic and international precedents on fair use, GenAI’s use of copyrighted works is likely to constitute fair use. Various technologies and facts surrounding the use of copyrighted works, from algorithm design to data collection and training, output filtering, and end-user prompts, can influence the determination of fair use. If prompts and output filtering are in place, the likelihood of copyright infringement by GenAI’s output appears slim. Even if courts determine that fair use constitutes fair use and resolve individual disputes, conflicts and disputes arising from changes in the creative ecosystem and copyright market will continue. Considering the social costs of future lawsuits and disputes stemming from the abstractness and ambiguity of fair use requirements, the argument that legal amendments to introduce time-based modeling (TDM) exceptions along with a copyright holder opt-out option are persuasive.
