Abstract

Online business intermediary services have become extremely important in actual business practices. In the past, online intermediary services were merely one of several available business options and had limited influence and social impact. However, they have now positioned themselves as one of the main business methods that cannot be ignored. The benefits brought by online intermediary services have made it difficult for business users and consumers who have used them to withdraw easily. In fact, the attractiveness of these services can at times lead to abuse, which, when it occurs, may result in considerable social and economic losses. To regulate the fairness and transparency of online intermediary service providers, the European Union has established a regulatory framework for such platforms through the enactment of the EU Digital Platform legislative package. The ‘EU Digital Services Act (DSA)’ aims to enhance transparency and safety for users in the online environment and promote the growth of innovative digital businesses. To achieve this, it imposes clear, effective, and predictable obligations on intermediary service providers to create a safe and transparent online environment, while also improving the functioning of the internal market. Specifically, it addresses issues such as hate speech, sexual harassment, and other discriminatory acts targeting consumers, minors, and vulnerable users. It pursues various public policy goals, including ensuring the safety and trust of users, holding service providers meaningfully accountable for protecting fundamental rights as specified in the ‘EU Charter of Fundamental Rights,’ empowering users and other affected parties, and supporting the necessary supervisory roles of competent authorities.
