Abstract

The philosophy of law is a philosophical explanation for the question whether the norm as law is functioning properly as a form of life, and a way of thought for that explanation. Broadly speaking, if the methodology of modern philosophy can be called “critical,” legal philosophy is critically thinking about the above question, which ultimately leads to seek and suggest new ‘art of life’ by evaluating current ‘art of life’. There are “general subjects” and “specific subjects” in this philosophy of law. we can summarize the general theme: First, the subject of legal ontology, second, the subject of legal value theory, third, the subject of legal epistemology. And the political philosophy of law and the critical philosophy of law can be suggested as a topic derived from general themes. There is also a specific theme of legal philosophy, which can be called “hic et nunc philosophy of law” because it is the legal philosophy that begins in our lives. In particular, Korea’s legal philosophy here is subject to the understanding of the Western legal system(the Ius system) and the understanding of the legal culture of East Asia at the same time. Furthermore, I would like to propose subcategories of the philosophy of law in order to properly perform its mission as ‘art of life’. They are the legal philosophical eunomics and the legal philosophical futurology.
