본고는 개원 2년이 지나가고 있는 현 시기 로스쿨 체제 하 법철학 교육의 현황과 과제에 대하여 살펴보았다. 특히, 법철학 교육내용과 교육형식, 제도적 여건에 대하여 검토해 보았으며, 실증적 연구를 위해 10여 개 학교를 대상으로 한 설문조사를 실시하였다. 고찰의 순서를 살펴보면, 우선 법학의 대상영역에 대한 학문이론적 고찰을 크라비츠와 피벡의 이론을 중심으로 개관하고 법철학 교육내용의 가능한 형태를 유형화해 보았다. 그리고 그러한 유형화에 비추어 현재 우리 대학들의 법철학 교육내용이 어떤 형태를 띠고 있는지에 대해 설문결과를 바탕으로 분석해 보았다. 다음으로는 보론의 형식을 빌려 로스쿨 체제하 법철학 교육형식의 현황에 관한 설문조사분석을 간단히 소개하였다. 뒤따르는 장에서는 법철학 교육의 내용과 형식이 위치해 있는 제도적 여건이 현재 어떠한지를 역시 설문조사결과의 분석에 기초하여 검토해 보았으며, 마지막 장에서는 현재의 상황 속에서 법철학교육의 개선과 발전을 위해 무엇을 할 수 있을지에 대해 간단히 살펴봄으로써 논의를 마무리 지었다.
Abstract
In this paper, the status and the problems of the education of philosophy of law under the current law school system that opened two years ago, have been examined. Especially, the curriculums and educational forms of philosophy of law and institutional conditions have been reviewed, and then a survey, targeting 10 schools, has been conducted for empirical research. With respect to the order of the review, in the first place, the review on the object areas for law in the light of science of philosophy has been looked over by focusing on the theories of W. Krawietz and Th. Viehweg, and then through such patternization, the available forms of the curriculums for philosophy of law have been patternized. Next, the forms taken by the curriculums for philosophy of law in the Korean colleges have been analyzed based on the survey result. After this, by borrowing the types of boron, the analysis of survey for the status of the educational forms of philosophy of law under the current law school system was briefly introduced. In the following chapters, the institutional conditions where the curriculums and the educational forms of philosophy of law are placed, have been reviewed based on the analysis of the survey results. And in the last chapter, what could be done for the improvement and the development of the education of philosophy of law under the current circumstances, has been briefly viewed before the closing of our discussion.
