나르시시즘은 모든 인간의 보편적 정신특성의 하나이다. 프로이트에 의하면 나르시시즘이란 리비도가 자기(성)애에 갇혀 있는 정신특성을 말한다. 또한 그에 의하면 리비도의 외부화, 사회화(승화)를 통해 사회적 인격이 형성되는 반면, 외부화, 사회화되지 못한 리비도가 자기애로 귀환하게 되면 자폐유사상태나 신경증의 증상이 나타난다. 전자를 긍정적인 나르시시즘으로, 후자를 부정적인(퇴행적인) 나르시시즘으로 차별화할 수 있다. 프로이트의 정신분석학적 의무는 자기애적 리비도를 충족시키는 무한사랑을 상실한 삶을 노동으로 구성하고, 그 삶을 견디어낼 것을 요구한다. 나르시시즘이 모든 인간의 보편적 정신특성이라면, 법은 나르시시즘적 인간을 자신의 인간상으로 전제하여야 한다. 또한 법은 프로이트의 정신분석학적 의무의 실현을 자신의 내재적인 윤리(법윤리)로 삼아야 한다. 그에 따라 법은 나르시시즘의 긍정적 발현을 촉진하는 반면, 부정적 발현을 억제하는 방향의 규율을 하여야 한다. 가령 법은 존엄사 조력은 긍정하여야 하는 반면, 자살조력은 금지하여야 한다. 또한 법은 인간성의 확장으로서 동물사랑을 긍정하는 반면, 동물을 의인화하는 퇴행적 나르시시즘의 동물사랑을 조장해서는 안 된다. 이와 같은 법과 나르시시즘의 관련지음을 통해 새로운 포스트프로이트의 윤리(postfreudian ethics)가 되는 법윤리가 정립될 수 있다.
Abstract
Narcissism is one of the universal mental traits of every human being. According to Freud, narcissism refers to the mental trait in which libido is stuck into autoerotism. The externalized or socialized (sublimated) libido forms the social personality, while the unexternalized or unsocialized libido which returns to narcissism appears as symptoms such as quasi-autism or neurosis. The former can be defined as the positive narcissism, while the latter as negative (regressive) narcissism. Freudian psychoanalytic duties based on the mortality of human beings demands them to labor and endure the life which has lost infinite love to satisfy narcissistic libido. Law should assume the narcissism as the universal character of Human beings and internalize the Freudian psychoanalytic duties in its category. With the Freudian psychoanalytic duties, law shall promote positive aspect of narcissism or regulate its negative aspect. Law could, for example, allow the assistance of death with dignity on the one hand and prohibit that of suicide on the other hand. Also, law could encourage love of animals for the expansion of humanity but discourage anthropomorphic love as the regressive narcissism. Through the hermeneutic interrelationship of law and narcissism, the Freudian psychoanalytic duties become the law which could be called Postfreudian Ethics.
