현행 자치경찰제의 한계와 과제 - 주로 시민 참여를 중심으로 -

본 논문은 현행법에 관한 검토를 통하여 현행 자치경찰제에 관한 이해를 명확히 하고, 자치경찰제에 기대되는 본래의 의의와 역할, 현행 제도의도입 취지에 비추어 현 시점에서 기대할 수 있는 최선의 도입 방향 내지운영 방안을 모색해 보는 것을 목적으로 한다. 자치경찰의 의의와 역할, 경찰법 전부개정 이유 등을 고려할 때, 현행 자치경찰제의 도입 취지는 (1) 지방자치를 위한 국가경찰 권한의 분권화, (2) 지역특성 및 주민 수요에 따른 치안서비스의 제공, (3) 비대해진 경찰권의효율적 분산이다. 그런데 현행 자치경찰제는 이른바 일원화 모델을 바탕으로 도입된 제도이기 때문에, 다수의 연구에서 지적하는 바와 같이 자치분권의 실현과 경찰권력의 분산이라는 자치경찰제의 도입 취지를 충실히 반영하기 어렵다. 다만, 현행 제도는 자치경찰제의 도입 시 고려되어야 할 다양한 사항을검토한 결과를 바탕으로 마련된 단계적 추진을 위한 시행모델 내지 과도기적인 제도화라고 볼 수 있다. 따라서 이후의 과제는 과도기적 단계의 자치경찰제를 온전한 제도로 만들어 가는 것이고, 현 상황에서 자치경찰제의점진적인 발전과 단계적 정착을 이끌어 낼 수 있는 동력은 시민의 참여이다. 그러나 현행법을 검토해 볼 때, 시민 참여에 관한 명문의 규정이 거의없고, 시민이 참여할 수 있는 기회도 많지 않다. 이러한 점 등은 향후 법개정 등이 필요하다고 여겨지며, 현행 제도 하에서는 조례 등을 최대한 활용하여 시민이 참여할 수 있는 방안을 마련해야 할 것이다. 예컨대, 실무협의회를 규모별, 계층별로 구성하여 더욱 다양한 분야의 시민이 참여할수 있도록 하는 방안, 자치경찰의 활동을 점검하고 평가할 수 있는 시민점검단 구성, 시민의 활동을 보조할 수 있는 지역 전문가로 구성된 자문단의 운영 등을 생각해 볼 수 있다. 그 밖에도 현행 법제도 하에서 도입 가능한 다양한 시민 참여의 방안을모색하여, 자치경찰사무의 목표 설정에서 실행에 이르기까지 시민과 함께하는 시민주도형 자치경찰제가 자리 잡을 수 있기를 기대한다.
Abstract
This study is aimed to make sure the understanding on the current autonomous police system by reviewing the present regulations; and to seek the optimal introduction direction and operational plans that can be anticipated at present, reflecting the original meanings and roles of the system, and purposes of the existing system introduction. Considering the meaning, roles of the autonomous police, and the reasons of general revision of the Police Act, the purposes to introduce the present autonomous police system are (1) to decentralize the authority of national police for the local government, (2) to provide the public security services according to the local characteristics and demands of inhabitants, and (3) to distribute the bloated police power. Since the current autonomous police system was introduced based on the unification model, it is hard to apply the intentions of the system introduction such as realization of autonomy and decentralization, and distribution of the police power as criticized in multiple studies. However, the current system might be an implementation model or transitional system for step-wise approach prepared based on the review outcomes on many considerations when introducing the autonomous police system. Therefore, the future task is to make the transitional system into the complete one, and citizens’ participation is the driving force to develop the autonomous police system gradually and to stabilize it in a stepwise way at the moment. However, reviewing the current regulations, there are few documented regulations on the citizens’ participation and few opportunities of their participation. It is necessary to amend the regulations on this in the future. In addition, it is anticipated that autonomous police system driven by citizens will be well positioned from goal setting up to the implementation of the autonomous police administration, seeking multiple plans for citizens’ participation under the current regulations.
