Abstract
Contemporary debates about the nature of law often have focused and are still focusing on the necessary and essential property of law. Can the characteristics that define or explain the nature of law be merely descriptive, morally evaluative, or some combination of these? This question is the main theme of legal positivism and natural law theory. Following F. Schauer, this article tries to explore these important questions by arguing that an exclusive focus on necessary features or properties of law leads to an impoverished picture of law, and instead that our attention ought to be paid to important or valuable aspects of law. That is, we should evaluate, justify, and ascribe moral importance and values to what we identify as law. Then, it might be thought that such ideas and approach lead us directly to natural law theory. However, it is obvious that the fact of reasonable pluralism and profound disagreement regarding philosophy, ethics, religion and justice make the project of traditional natural law theory impossible. Therefore, we should looking for an alternative non-positivism which is compatible with the fact of reasonable pluralism. This article aims to combine Rawls’s idea of public reason and the central tenets of non-positivism, and to develop a ‘public reason’ version of non-positivism. In elaborating normative foundations that build up such a version, this article draws heavily on S. Darwall’s theory of second-person standpoint and tries to interpret and construct immanent ideals and principles that are embodied, even if imperfectly, in our legal practices and institutions.
