‘법의 지배’의 침묵과 그 적대자들

법의 지배가 ‘좋은’ 법의 지배라면, 그리하여 법의 지배가 선정(善政)을 위한 조건의 필요성을 소화하려 드는 순간, 그 개념에는 독립적 기능이 하나도 남지 않는다. 법은 사회를 구성하고 운영하는 여러 가지 수단 중 하나일 따름으로, 다른 수단이 제대로 기능할 수 있도록 기본 틀을 제공하는 역할을 한다. 따라서 다른 수단이 수행하는 역할을 전부 법이 대체하려고 해서는 안 된다. 법의 지배만이 우리가 추구해야 할 유일한 정치적 이상이라고 할 수 없는 이상, 법의 지배에 지나치게 의존하는 것은 현명하지 못한 처사이다. 이를 해명하기 위하여 저자는 이 글에서 법의 지배가 말하지 않는 것을 밝히고 그것을 위협하지만 정작 잘 드러나지 않는 적대자를 색출하고 있다.
Abstract
If the rule of law is the rule of ‘good’ law then to explain its nature is to propound a complete social philosophy. However, if so, the term would lack any useful function. Law is merely one of various means that constitute and run the society, primarily providing a fundamental framework so that the other means can function properly. Therefore, law should not be taken to replace all the roles that the other means play. Since the rule of law is not the only political ideal that we should pursue, it is not rational to heavily rely on the rule of law. To vindicate this proposition, the author identifies what the rule of law does not claim, and tracks down the enemies that actually, though unbeknown to us, threaten it.
