법의 지배와 좋은 정부

초록

이 논문은 좋은 정부와 법의 지배 논의에 있어 민주주의의 의미를 중점적으로 검토한다. 논문은 크게 세단계로 진행되는데, 먼저 법의 지배와 민주주의의 관련성에 대해 검토한다. 이를 통해 좋은 정부에서의 법의 지배와 민주주의가 갖는 상호관련성의 함의를 찾아본다. 다음으로는 법의 지배에서의 법의 본질 및 내용과 민주주의의 관계에 대해 검토한다. 이를 통해 좋은 정부에서의 법은 어떠한 법이어야 하며, 이것이 민주주의와는 어떠한 관계를 갖는지 알아본다. 마지막으로 좋은 정부를 평가하기 위한 유의미한 지표로서 법의 지배는 어떻게 이해되고 어떠한 내용으로 구성되어야 하는지를 결론으로서 제시한다. 이러한 논의를 통해 좋은 정부 또는 정부의 질 연구에 있어 법의 지배 논의의 방향성을 찾아가고 논의의 내용을 보다 풍부하게 하는데 이 연구의 의의가 있다.

Abstract

This paper focuses on the meaning of democracy in the discussion about the rule of law and good government. This paper consists of three parts. First, it reviews the relationship between democracy and the rule of law in good government. Second, it examines the significance of democracy in the nature and the contents of law. This helps analyze the contents of law in good government. Lastly, it suggests how the rule of law as a significant indicator should be understood and be composed in good government. The purpose of this paper is to seek direction and to enrich the contents of the rule of law in studies of good government and quality of government.
