법치주의를 형식적으로 이해할 필요

우리 헌정의 기본이념 중 하나인 법치주의 또는 법의 지배를 어떻게 이해할지에 관하여는 다양한 견해가 제시되어 왔다. 법치주의는 갈리(W.B. Gallie)가 제시한 ‘본질적으로 경합적인 개념’이 아니다. 법의 형식이 아니라 법의 내용이나 법을 제정하고 시행하는 절차에 관한 요청까지 포함하는 실질적 법치주의는 개념적 혼돈을 초래한다. 법치주의는 형식적으로 이해하는 것이 타당하다. 법치주의를 형식적으로 이해할 주된 필요는 다음과 같다. 첫째, 법치주의의 내용으로 모두가 동의할 수 있는 부분이다. 둘째, 법치주의를 헌정이념 전체와 동일시하지 않음으로써 자유주의, 민주주의 등 여타 헌정이념들과의 관계를 분석하고 파악할 수 있다. 셋째, 그 이념의 역사성을 이해할 수 있고, 일반적이고 보편적인 법치주의 개념도 확보할 수 있다. 넷째, 그 자체로 선(善)인지, 인간존엄과 어떤 관계가 있는지, 어떤 헌정론이 그 이념과 친한지, 법개념론과 법치주의론의 연관은 어떠한지 등 관련 문제를 분석적으로 성찰할 수 있어서 이론적 발전을 촉진한다. 형식적으로 파악된 법치주의의 요소는 풀러가 법의 내적 도덕성으로 제시한 것들을 기본으로 삼는다. 법은 일반적이어야 하고, 공개되어야 하며, 소급하지 않고, 이해할 수 있고, 모순되지 않으며, 할 수 없는 것을 요구하지 않고, 안정적이고, 정해진 대로 집행되어야 한다는 요청이 그것이다. 그리고 입법에 제한이 있다고 하는 형식적 입헌주의 요소는 그런 제한이 없는 법에 의한 지배(rule by law)로부터 법의 지배(the rule of law)를 구별할 수 있게 하고 법치주의에 관한 역사적 성찰에서 주된 요소이므로 그 이념에 포함할 필요가 있다.
Abstract
Many different views have been proposed on how to understand the rule of law, which is one of the fundamental ideas of the Korean Constitution. The rule of law is not an "essentially contested concept" suggested by W.B. Gallie. And the substantive conceptions of the rule of law, which include claims about the content of laws and the procedures for making and enforcing them as well as the form of laws, are useless ones that lead to conceptual confusion. Therefore we need to understand the rule of law formally. The main needs for a formal understanding of the rule of law are as follows. First, it is the part of contending conceptions of the rule of law that everyone can agree on. Second, by not equating the rule of law with the entire constitutional ideals, it is possible to analyze and understand its relationship with other constitutional ideals such as liberalism and democracy. Third, the historicity of the idea can be understood, and a general and universal concept of the rule of law can be obtained. Fourth, it promotes theoretical development by analytically reflecting on related issues such as whether it is good in itself, how it relates to human dignity and how the theories of law relate to the theory of the rule of law. The formal elements of the rule of law are based on what Fuller calls the internal morality of law. These are generality, publicity, prospectivity, intelligibility, consistency, practicability, stability, and congruence. And the element of formal constitutionalism, i.e., limits on legislation, is necessary to the rule of law because it distinguishes the rule of law from rule by law without such limits and is a key element in historical reflections on the rule of law.
