Abstract

As a concept recognized by the Federal Constitutional Court of Germany(FCCG), satire, and caricature as one type of satire, can be explained by three characteristics: ① indirectness ② critical ridicule on idée reçue (generally held opinion) and ③ aesthetic portrayal. Satire and caricature are protected by the freedom of expression of opinions (Article 5, Paragraph 1, Sentence 1 of the Basic Law). It would be natural to see satire as belonging to the freedom of press (Article 5, Paragraph 1, Sentence 2 of the Basic Act) when it depends on the form of the publication. However, the decision of the Federal Constitutional Court shows that these are basically protected by the freedom of expression of opinion (the Sentence 1). Satire may also be an art (Article 5, Paragraph 3 of the Basic Law). The freedom of art of the German Basic Law is a provision without individual legal reservations, so if the satire corresponds to art, it is in principle protected more strongly. Before the normative assessment of the satire itself, the satire expression can be (and needs to be) interpreted precisely through the “stripping of the appearance”. In Germany, for example, there was a case in which a satirical cartoon was not classified as profanity or insult to a religious group because the expression of opinion expressed an intellectual approach to serious discussion. The legal limitations on this “appearance” have changed, and have often been extended, due to changes in socio-ethical thinking in Germany. In examining the actual cases, this study focused on cases of religious groups and religious people rather than cases of politicians and public officials. As for the types of satire expressions that are in conflict with the interests of third parties(for example other individuals), things such as “destruction of religious feelings” or “defamation of character which is based on the religious affiliation of the believers” is not yet recognized in Germany. According to the jurisprudence of FCCG and the legal system of Germany, the limitation of expressing a satirical opinion on a religion can only be approved in extreme cases by the components of the insult and the conditions of the Federal Constitutional Court has established in that respect. In contrast, in a case of slander against a profession of faith itself, it can be confirmed that it is prohibited by law in Article 166 of the German Criminal Code. This is a legal boundary for freedom of press under Article 5 of the Basic Law as well as a general provision of an Act of Parliament. Also, according to the judgments of the judicature of Germany, this provision is closely related to the guarantee of freedom of faith under Article 4 of the Basic Law. This was exemplified in the case of “Birth of Jesus” and “Witchcraft in Poncho”. From the discussions at the Federal Constitutional Court in Germany, we could get some implications for dealing with issues on the satire and caricatures, in regard to interpretation and practice of constitutional law in Korea.
